FORFEITURE CLAUSE IN CTS/DOAS vs. CASH SURRENDER VALUE UNDER THE MACEDA LAW Many buyers of residential condominium units are unaware that the Maceda Law (RA 6552) provides important protections that override unfavorable contract terms. ⚠️ If a buyer has paid at least two (2) years of installments—including downpayments and subsequent monthly payments—the buyer is entitled to a Cash Surrender Value (CSV) of at least 50% of total payments made. This right cannot be waived and cannot be defeated by any forfeiture clause in a CTS or DOAS. ⚠️ If the buyer has paid less than two (2) years of installments, the buyer may not qualify for the CSV—but a blanket forfeiture of all payments is still not automatically valid. Courts require that forfeiture clauses be reasonable, and buyers may still recover a portion of what they paid despite a contract stating otherwise. Bottom line: Contract provisions forfeiting all payments do not prevail over the protections granted by law. Buyers have rights—and these rights are enforceable. If you are considering cancelling a purchase or facing forfeiture issues, consult a lawyer to understand your remedies and ensure your rights are protected.
