@1stLevelHuman @RonDeSantis By that logic, Congress can say the Constitution does not fully apply to undocumented immigrants. Of all the US overseas territories, citizenship was granted via statute NOT the 14th amendment. Clearly it can be selective.

@RonDeSantis Native tribes are sovereign— they have their own jurisdiction. Read the precise wording of the 14th Amendment. This is the same reason that American Samoa doesn’t automatically U.S. citizenship, like the other U.S. territories do— it has sovereignty.

@1stLevelHuman @RonDeSantis Amer Samoa rejected jus soli. They fall under the Insular Cases, territories where the Constitution does not fully apply, decided by Congress. Congress gets to decide where the Constitution applies and yet the 14th doesn't allow Congress to say when children aren't citizens?

@RonDeSantis If "the 14th mandates it" then why aren't those born in American Samoa citizens? They are subject to the jurisdiction of the US, they absolutely are subject to federal law, taxation, and cannot be deported anywhere. Explain

The Court never previously held that the 14th amendment requires birthright citizenship for the offspring of foreign birth tourists or illegal aliens. True, it was generally assumed that birthright citizenship was mandated, and that was what I was taught back in the day. But the scholarship in recent years has demonstrated that was not the understanding of the society that ratified the amendment. You shouldn’t have to pass a constitutional amendment; the Court has a responsibility to get constitutional questions right and to correct erroneous interpretations.

@RonDeSantis The 14th mandates it. Not the court. It is terrible policy. You know the way to fix this is by amendment. Support that, but quit attacking a court for applying plain language and following a century of precent.

Current position of the Supreme Court: Actual Native Americans were not covered by the 14th amendment until Congress passed a law extending coverage to them in the 20th century. Chinese birth tourists who have a child in the United States are of course originally covered by the 14th amendment and have produced a child more American than a 19th century Native American.

If you are a citizen of a foreign nation you have political ties and political jurisdiction in your home country. This is the distinction. As it stands the 14th is interpreted by the Ark case from 1898

@douglassmackey Whether you agree with whether or not it should be legal is irrelevant. Birthright citizenship is clearly defined in the constitution. If the Supreme Court allows presidents to ignore such clear language, the Supreme Court seizes to exist as a concept

The Supreme Court’s birthright citizenship decision is a bigger disaster than expected. Roberts and Barrett have completely sold out our birthright. The Court has ruled that an Act of Congress CANNOT overturn Birthright Citizenship, only a Constitutional Amendment. Since it’s impossible to seal off the borders perfectly and indefinitely, this ruling dissolves the United States as we know it. It’s the beginning of the end of the Republic unless and until we get a new Supreme Court to overturn this disastrous decision (like Roe v. Wade was eventually overturned).

If a foreign diplomat enters the US and commits a crime, do they just leave because they aren't under US jurisdiction? This is a terrible argument. Same with the NA exclusion. Tribal nationals? Same as a foreign national.

Fair enough. X is the "argumentative" side of my internet split-personality. Native Americans were excluded from the 14th Amendment in 1868 because they were viewed as members of independent, sovereign, Tribal Nations. This goes back to the "jurisdiction" word. When the 14th Amendment was written, Tribal Nations were treated as separate powers. Similar to how, still today, the children of foreign diplomats born on U.S. soil are not U.S. citizens. I'm telling you, the 14th Amendment is crystal clear to those of us who take definitions seriously. I completely understand every argument against it and how it's being abused. Being pro-open borders does not mean I am pro-open welfare. I have even offered real solutions to some of those arguments, but in order for any of that to happen, we have to, at the very least, agree on what the laws already say. The fact is, the power is within Congress, not some SCOTUS ruling. Congress needs to get together, or the states, and Amend the Constitution in a way that makes sense. While you only see detrimental side effects from illegal immigration, rest assured, there is someone like me that sees the positives. I have spoke to numerous people about this subject over the years and I will confidently say that there's one thing that I always hear, "If they come legally, I don't mind them." That is where I usually explain that our quota system is broken and that the majority of illegal immigrants would love to have crossed legally if it were ever a possibility. The fact is, millions of people would have entered legally if given the opportunity.

The Supreme Court will rule on birthright citizenship tomorrow morning… It’s not an exaggeration to say this could be the most important decision in our lifetimes. Under the current interpretation of the 14th Amendment, a foreign citizen of another nation can cross our border illegally at 9 months pregnant, give birth to an American citizen, and then return home. Their child is now eligible for US benefits and can vote in our elections. The Chinese can also pay to have surrogate children on US territorial islands in the Pacific, then immediately ship the babies to China to be raised under the CCP. Those children are now eligible for US benefits and can vote in our elections. Both of these scenarios are happening. It’s simply wrong and not at all what the Amendment was intended for, which was former slaves and their children during Reconstruction. If it stands, US citizenship means nothing.
