@rock4par @jphtandom @HodlMagoo Again, I think the crux of our misunderstanding is the conflating of coincidental lawful possession with being "armed" in the criminal sense. Courts generally treat "armed" as conduct-based, not the mere presence of a lawfully carried firearm.

Agani, since you either don't want to read it or chose to ignore it Legal carry → protected by 2A (in most contexts). - Resisting arrest → not protected, and often a separate crime. - Resisting arrest while armed → usually a felony with enhanced penalties, and 2A offers zero shield against prosecution.

@jphtandom @rock4par @HodlMagoo Officer’s perception or announcing “gun” does not supply the actus reus required to establish a nexus. Nexus is grounded in the suspect’s conduct, not officer belief. Courts have consistently held that criminal enhancement cannot flow from the exercise of a constitutional right.
