the bullet cannot be tied to the gun and the ballistic forensics are not consistent with impact of a 30.06, it will be up to the prosecution to tie the bullet to the gun, there is a reason they have not released the information on what type of bullet was in the gun, if its not hollow points then there is zero chance the gun was used
