@OrinKerr He might say he's distinguishing between a 3-judge panel's power to make circuit precedent and whether such a precedent counts as "clearly established" law for purposes of QI. But if a prior panel *held* the law to be clearly established on some point, the distinction dissolves.

I would have thought it common ground that circuit court judges are bound by circuit precedent. But am I right in reading this dissent by Judge Oldham as saying he doesn't and won't unless he thinks the panel op is wise or the Supreme Court requires it?ca5.uscourts.gov/opinions/pub/2…
