When spouses buy property together, how they hold it matters. In Nigeria, there are generally two ways: a) JOINT TENANCY b) TENANCY IN COMMON 🥢JOINT TENANCY Here both spouses own the property equally. If one dies, the other automatically inherits their share. This means the surviving spouse takes over the deceased spouse's share by operation of law, known as the rule of survivorship. Example: Mr. Jude and Mrs. Jane jointly bought a house in Maitama as joint tenants. If Mr. Jude dies, Mrs. Jane automatically becomes the sole owner of the house. The property does not form part of Mr. Jude's estate, and his children or relatives cannot claim any share in it. 🥢TENANCY IN COMMON In Tenancy in common, each spouse owns a defined share, which can be equal or unequal. If one dies, their share goes to their heirs, not automatically to the other spouse. Example: Mr. Adegoke and Mrs. Amina bought a block of flats in Ibadan and agreed that Mr. Adegoke owns 60% while Mrs. Amina owns 40% as tenants in common. If Mrs. Amina dies, her 40% share will pass to her children or beneficiaries under her will or according to intestate succession laws(if she died without writing a Will), not automatically to Mr. Adegoke. This distinction is important because it affects inheritance, sale, and your legal rights. It is advisable that you clearly state the type of joint ownership you desire to ensure your intentions are legally recognized and enforceable. A proper understanding of how you hold property jointly in marriage protects your rights, avoids disputes, and ensures your intentions are respected especially in cases of divorce and death.
