@clintwfischer Nicely written and so many farming families need to have the open discussion about the future. I believe the irrevocable trust also gives the benefits of a stepped up basis (current value), doesn’t it?

Protecting land from kids' divorces is a very common concern when I work with farm families. If you're in that boat, consider Sentry trusts as part of your plan. We use them all the time. The end.

Husband & wife have a row crop farm & also background cattle. About 2,300 acres owned. Rent a fair bit more. Two sons - both farm w/ Dad & Mom. Son #1 is married. Son #2 is divorced. One of the couples biggest concerns with their estate plan...

We’ve bought a new 10-inch, 73-foot swing-away auger and are wondering “how much” tractor we need to operate it. Will our 955 (33 hp) do it? Will our 3720 (44 hp) do it? Would a class 5 tractor (65 hp) do it? Thanks in advance!

@clintwfischer Stay with the “current plan” or risk family splits. Depends what mom and dad value - family unity (hopefully) or setting up the family for generations of division. IMO, equal is only fair in this situation.

Farm couple has 4 kids. Son farms some on his own & some with Dad. 3 daughters are off farm. There's: $5 million of land $750k of equipment $3.5 million of off-farm cash & LI Current plan: • Son gets option to buy equipment at 75% FMV • Land goes into a trust for benefit of all 4; ROFR and discount option on the land for son • Cash & LI gets split 4 ways The couple is concerned that son won't be able to buy the land, even at a discount and are toying with: • Equipment unchanged • Land goes to son • Cash & LI split between daughters We say "fair isn't necessarily equal", but that’s a big imbalance in inheritance. Curious what you would do if you were in their shoes...
