New FDA guidance is opening doors for rare disease innovation.

That’s how it becomes addictive! That is what an algorithm is, get with the program. If it were selecting a blank screen there wouldn’t be engagement.

Viruses are drastically underappreciated as a main cause of death.
A distant family friend passed away due to a heart attack. On arriving at hospital, they tested positive for Covid. Narrative wise everyone says the heart attack was the cause, but chances are Covid caused it.

yes, trillion dollar companies with backdoor access to everything about you that used neuroscience to design algorithms to addict teens & admitted their parental controls were useless while joking about addicting people like big tobacco famously the same as books made of paper

This is disgusting and I can’t wait for the appeals. The precedent set by YouTube being liable for screen-time addiction is kind of scary. Treating algorithms like a defective product opens the door to endless lawsuits over “addictive” tech. What’s next? Books, video games, junk food? What happened to personal responsibility?

I'm hoping that there are experts in tort law who will or have weighed in on this lawsuit, and I'd be interested to read their take. In particular, what's the line between an addictive website liable for user harms and non-addictive one that isn't?

These verdicts rest on a premise that is fundamentally flawed: that social media is just like any other product.
It is not.
No one would use an app that endlessly scrolls through blank pages or sends empty notifications, much less get “addicted” to it. The “product” in these “product design” cases is First Amendment protected expression.
Speech does not and cannot exist in a vacuum. It is expressed in a particular way, at a particular time, using particular mechanisms to communicate it to others.
The curation and presentation of speech is inherently interwoven with its very expression.
Once you understand that, you realize that you cannot regulate “product design” without also regulating First Amendment protected expression.
