Probably the best take I have heard on why there is so much fear around software exposure in private equity and credit because of AI From David Sacks "Historically we only had two good exits for software businesses. One was IPO. The other was M&A. Then these big private equity shops came along and gave us a third potential exit. You would sell to them and then they would raise the capital based on one third equity and two third debt. So it was debt financed buyouts. It is something that has been around in the non technology part of the economy for a long time but was a relatively new entrant in the world of technology. And the reason for that is if you have debt financed a purchase, you need to have very stable cash flows. Because if you miss and you cant pay your interest on the debt, you will lose all your equity because the debt holders will foreclose. It was belief for a long time that software did have predictable cash flows, at least for the mature businesses."

David Sacks: The AI Regulatory Frenzy at the State Level is “Very Concerning” “Let me give you some stats on this.” “All 50 states have introduced AI bills in 2025.” “There's been over 1,000 bills in state legislatures.” “118 AI laws have already been passed across the 50 states.” “Everyone just seems to be motivated by the imperative to ‘do something’ on AI, even though no one's really sure what that something should be.” “And there's no real agreement on what all these AI regulations are supposed to do, or what the risks are, so they're just making things up.” “So you've got 50 different states each with their own reporting regime, which is going to be a trap for startups because they've all gotta figure this out about what they're supposed to report on, what the deadlines are, who to report to.” “And if you wanna see where this is going, look at Colorado.” “This has already been passed into law, SB 24-205, Consumer Protections for Artificial Intelligence. It bans something they call ‘algorithmic discrimination.’” “Algorithmic discrimination is defined as unlawful differential treatment or disparate impact based on protected characteristics. So things like age, race, sex, disability.” “If any of those factors drive an AI decision and it results in a disparate impact, then both the developer of the AI model and the deployer, which means the business that's using it, can be in violation of this law and they can be prosecuted by the Colorado Attorney General.” “The only way that I see for model developers to comply with this law, is to build in a new DEI layer into the models, to basically somehow prevent models from giving outputs that might have a disparate impact on protected groups.” “So we're back to Woke AI again, and I think that's the whole point.”

Kudos to @xAI for being the first AI company to challenge a Colorado law requiring it to censor truthful answers if they could have a “differential impact” on protected groups. This is Woke AI. It teaches AI models to lie. And it’s a violation of the First Amendment.

Today, @xAI sued Colorado to stop a new law (SB24-205) that would force Grok to promote the state’s ideological views on various matters, racial justice in particular. Colorado wants to force Grok to follow its views on equity and race, instead of being maximally truth-seeking. Reverse discrimination does not undo historical injustices but rather perpetrates new ones against a different set of individuals. This foments social strife and undermines the ideal of America as a meritocracy. AI models should not be taught that this practice is justified.

This is the best take I have heard around the existing AI landscape today Fantastic explanation around the constraints at OpenAI and Anthropic, focus on enterprise business models, and the doomerism narrative in AI From former AI czar David Sacks "Even though Anthropic's revenue has followed this exponential graph very predictably, it cannot do that ever. The reason is that as you hit new levels of scale, you encounter new problems. You are simply going to run out of compute, electricity, data centers, and infrastructure. There are limits to the physical world you are going to hit. And there is already evidence that Anthropic is hitting some of those limits."
