@BarExamTutor Personally, I did not have any accommodations on any of my law school exams nor did I have any on the LSAT. I have zero issue with my colleagues and classmates having accommodations. Not my call, I trust that they seek them in good faith.

To be clear, I don’t think anyone can reasonably argue that having extra time on a strictly timed test is not an advantage. The relevant question, though, is whether that given advantage provides a test taker an advantage over others or instead counterbalances the disadvantage of the disability such that now it’s a more equal field. Those who think the disability itself is a farce will of course deem the advantage unfair. But those like myself who accept that people start at a disadvantage due to a variety of diagnoses will believe in the counterbalance theory.

@dilanesper It’s very concerning to me that I think an 8-1 with Alito dissenting is a very likely possibility. There are many legal issues where i think there’s at least a tenable argument for a dissent to make. This absolutely is not one of them.

Prediction: the birthright citizenship case is 8-1 or 9-0 against the administration, on the constitutional issue. There's a lot of wishful thinking about "they'll make a statutory holding" but i think this will be a sweeping affirmation of the 14th amendment.
