The arrest of a student activist Takunda Mhuka after he was allegedly ambushed by suspected ZANU PF thugs exposes a blatant double standard in Zimbabwe's justice system. Takunda Mhuka was denied bail for alleged malicious damage to property valued at just $10 USD. The court cited overused reasons.He was arrested after reporting that he was ambushed by suspected ZANU PF thugs at his workplace in Waterfalls. He went to the police as a victim, but in a shocking turn, he ended up in handcuffs. His real offence? He openly voiced opposition to CAB3 an exercise of freedom of expression guaranteed under Section 61 of Zimbabwe's Constitution. He will appear again at Mbare Magistrate Court on 24 April 2026. Meanwhile, Doug Coltart's phone was stolen, the act captured on camera by a journalist, yet the suspect remains at large. One then questions the justice system of Zimbabwe: a $10 allegation lands a young activist in remand, but a caught on camera theft from a lawyer yields no arrest. What about the phone that was stolen? Is a $10 allegation now a greater threat to public order than a caught on camera theft? The victim becomes the accused. PRESS STATEMENT By Senator Jameson Zvidzai Timba Convenor – Defend the Constitution Platform (DCP) Harare | [10 April, 2026] Executive Interference in Independent Commissions Must Be Rejected The purported reassignment of Ms Jessie Majome from the Zimbabwe Human Rights Commission to the Public Service Commission raises grave constitutional concerns. This action is not administrative. It is constitutional. The Zimbabwe Human Rights Commission is an independent constitutional body, established under Chapter 12 of the Constitution, and protected from interference by any arm of the State. Its leadership cannot be reassigned at will. The Constitution is clear: A Commissioner may only be removed through a transparent tribunal process, grounded in law and due process. No such process has been presented. What is being described as a “reassignment” is, in substance, a removal without due process. This is unconstitutional. A Dangerous Precedent The timing of this action, coming shortly after the Commission raised concerns regarding the conduct of public hearings, is deeply troubling. It sends a message that: Speaking truth carries consequences Oversight institutions must align or be neutralised Constitutional bodies are subject to executive convenience This is not how a constitutional democracy functions. Our Position We therefore state the following: The reassignment is unconstitutional and invalid It represents executive encroachment into an independent Commission It undermines the integrity of all constitutional oversight bodies Our Demands We call for: The immediate reversal of this decision Full disclosure of the legal basis for this action Protection of all Commissioners from political interference The Broader Principle Independent Commissions are not extensions of the Executive. They are guardians of the Constitution. When they are weakened, the Constitution itself is weakened. Conclusion Zimbabwe cannot defend its Constitution while simultaneously eroding the institutions designed to protect it. This is not merely about one individual. 🇿🇼 Court Update: Takunda Mhuka's bail ruling did not proceed today because the magistrate is said to have had an urgent meeting and postponed all his matters to tomorrow. ➡️We continue to stand in solidarity with @Mhukatakunda and demand his freedom, as he is a victim of violence related to the Constitutional Amendment Bill No. 3 of 2026. ➡️He was assaulted at his workspace after allegedly being visited by politically aligned men who claimed that Takunda was one of the young Zimbabweans who opposed the CAB3 during the public hearings. 🔴 In unwavering solidarity with all Zimbabweans who were unjustly arrested, detained, or harassed during the Constitutional Amendment Bill No.3 public hearings. Among them is a young, Takunda Mhuka @Mhukatakunda , who was attacked by thugs claiming he attended the consultation not in support of the bill. They destroyed at his work space, and after reporting the incident, a politically aligned youth leader in Waterfalls falsely accused him of damage, leading to Takunda’s arrest. Today, Takunda appeared in court, and his bail application was postponed to 2 p.m. tomorrow. Will justice prevail? Will those responsible for assaulting and victimizing this young person face accountability? We continue to call on responsible authorities to immediately release Takunda and hold those who attacked him accountable. Such actions reinforce the perception that Zimbabwe’s courts are captured, punishing dissent in a country that claims to be democratic. We will not remain silent. Pay its leaders off the payroll so that they can defend your nonsense. And do that again. Give every influencer a car. Push them into leading narratives in the spaces they occupy so that your image is cleaned up. And do that again. There’s just no way that thing can be anyone’s President. NEVER!
