As we’ve said for years. All the gun ban propaganda outlets are basically part of political/financial clearinghouses. It’s all fake. It gives the NPC an illusion of a group and to give low information voters talking points that they can spread to the ideologically aligned.

@MorosKostas @CamEdwards This is the problem with Footnote 9. There is no logic to it. No other right would require traveling to every state and pay $ to exercise that right there. Unlicensed open carry on your person and carry in general about your person historically never required a license at all.

Oh jeeze. Can someone who knows him please tell Judge Grasz about the travelers exception laws? Because that is EXACTLY what our historical tradition says; travelers get special leeway when it comes to the right to carry. So infuriating this didn't come up at all, such a missed opportunity in the 8th Circuit. I really wish I managed to submit an amicus brief there. I realize the argument hasn't been raised, but they should remand it for new briefing and a ruling with the travelers exception history factored in. If they would just read our Gardner brief....ugh.

@hannahhill_sc Good win. Half the stuff on that application wouldn’t pass a faithful application of Bruen. Requiring references to sign the app, employment is irrelevant, and the SSN violates the privacy act of 1975.

Unlike most areas of 2A challenge, NY's requirement that social media history be considered in carry permit issuance directly conflicts with Bruen's main holding - that the right to carry can't depend on (among other things) local officials' discretion. Major props on this win!

@lecternleader @LivCaputo He also opposed dropping the licensing requirement for concealed carry. But he’s a “tough on crime” TV sheriff and PR is what really matters in politics.

@sigilosos76 @gvpillinois Don’t expect the Roberts court to take it either. No state had a possession license of any kind until 1908 (New York). It was so poorly written that it wasn’t really enforceable until 1911 with the Sullivan Act. There is no historical analogue to this.

@CamEdwards @2Aupdates @MorosKostas We’ve been at this long enough (you as well Cam) to know they will do anything to get as close as they can to universal registration and a possession license. They’re frustrated because America didn’t go the way the rest of the commonwealth countries did around 1920.

I look forward to reading your take. FWIW, I did do a followup after reading the full 67-page policy doc. Didn't really change my opinion. With the goal being "'craft a policy that red states could possibly live with' not necessarily craft a policy that would be used to roll back blue states," (BJ's words), we're left with something that requires gun owners to accept "red flag" laws, universal background checks, prohibitions on gun ownership for those convicted of violent misdemeanors, storage mandates, and allowing lawsuits against the firearm industry for marketing firearms... at least under certain conditions. As I wrote in my followup - What gun owners may view as a ceiling and the upper limits of what they could support, gun control activists get to use these policies as a floor for even more restrictions in the future. bearingarms.com/camedwards/202…

I'll be reviewing this at some point this week or next and providing my thoughts. I was dismissive of it as just another 97 Percent. And maybe it is. But @Freakoutery's involvement makes me owe it at least a more serious read through. Will provide my thoughts, or maybe a long thread with many thoughts. We'll see.

Our amicus brief in Gardner referenced this couple, as they tried to get as many carry permits as they needed to carry in as much of the country as they could. Yesterday they published an updated video. To carry in 46 states and DC (the final four won't let them apply), they needed to spend almost $13,000. Is this something supported by our historical tradition that the founding generation would have tolerated? Of course not. SCOTUS needs to grant cert in Gardner and end this exorbitant poll tax on the right to carry. Requiring one permit is already suspect enough given the lack of historical support for it. But even accepting that the Supreme Court blessed such a requirement in Bruen's footnote 9, other states should have to honor that, and not require everyone get their state's permit too.

It was not at all certain when we did CRPA v. LASD whether nonresident carry was going to be a win for us. Sure, it's absolutely crazy to think the right to carry could end at state lines, but given the Bruen defiance we've seen from so many courts, absolutely crazy rulings can happen. But our Biden-appointed judge did the right thing and forced California to begin issuing permits to nonresidents, and now others are falling like dominoes. Only a few states left which either don't issue to nonresidents at all (Hawaii, which Alan Beck is now challenging) or only issue to certain nonresidents. Illinois is the latter. If they have any brains, they'll change their system ASAP before they are forced to do so. Nonresident permits are far from ideal, of course. You shouldn't need to get a permit to carry in every state you visit. But while the filibuster exists, for that to change we'll need SCOTUS to act in a case like Gardner.
