Here are the applicable regulations from the DOL
Employers seeking to hire foreign workers on a permanent work visa must advertise the job to confirm there are no US citizens available to work in that role - if qualified US citizens apply the employer may pause the application but they don’t have to hire the US applicants.
This needs to become illegal. It is data collection + intimidation of existing employees + stock market manipulation + HR pretending to be working. Literally nothing is good about it and it damages the social fabric a lot.
