Disparate impact should never have been extended outside of the employment law context. It was only ever created because proof of disparate treatment could rarely be discovered because of the resource imbalance between plaintiffs and defendants. Insane takes like this are the result of that legal fiction.

This is the part of the ruling that really kills the VRA. Basically means that racial gerrymandering is permissible if it's the only way to attain a partisan goal; you can't draw eg a 7-0 in Alabama that doesn't racially gerrymander, so the alternate map standard is impossible.

@JimCarrollSF @realestatedude0 I can’t imagine it being worthwhile unless you’re already suing, and even then maybe not. For example if the procedural posture is wrong (e.g., post-default) repleading or moving to plead a supplemental complaint to claim an additional $300 creates a lot more risk than reward.

@PitBottomSuper @kitten_beloved Times New Roman is ugly. Century Schoolbook is a standard typeface available in Word. It makes sense. Florida appellate courts require either Arial or Bookman Old Style. The latter is just so disgustingly wide.

It’s a matter of good document design and enhances readability. It’s a practice that should be adopted in general legal writing (like briefing and pleadings) over 1" with double spaced lines because the latter is just not as readable, and you can make much more useful handwritten notes by writing in the margins.

@horadrimsage @SMB_Attorney The first thing is technically already done by signing a court filing under Rule 11 or the state’s equivalent. Requiring a separate certification is just more wasted space. Bar discipline definitely needs to start happening in these more egregious cases.

@SMB_Attorney A simple solution would be for the a Filer to certify that all references have been checked under penalty of something. And/or have the Bar start suspending licenses. People take shortcuts, but this is unexcusable

@ElectionCenter_ This isn’t how the Court’s jurisdiction works. If they purported to rule on a matter not properly before them, it would be dicta (though as a practical matter, highly persuasive inasmuch as one would expect the Court to rule that way in a future case).

@ElectionCenter_ You have to look at WHY the VRA doesn't require that seat, which is outlined in the opinion today. For the same reason that the 2nd seat isn't required, the 1st seat is also unlikely to be required. Not sure what the disconnect is here.

@marcorandazza If you have a vote you are represented. Our society isn’t composed of affinity voting blocs. This isn’t Lebanon (President must be Catholic, PM must be Sunni, Speaker of House must be Shiite) or New Zealand (seven reserved seats of Parliament for Māoris).

@Patrick30887310 It says it right in his bio—he's an Old Catholic. Look it up? They split from the Catholic Church after Vatican I. Whether or not he's a *parish* priest is irrelevant, of course; lots of Catholic priest in good standing aren't parish priests.
