Hoy una persona se despierta, toma su teléfono y, sin darse cuenta, ya fue rastreada, perfilada, clasificada. No firmó nada consciente, no negoció nada real. Solo existió en digital. Ese es el punto de partida del siglo XXI: vivimos en un espacio donde la tecnología no solo conecta, también observa, decide y, muchas veces, condiciona quiénes somos. La Carta de Derechos en el Entorno Digital intenta poner un alto: decir que la dignidad no se negocia, que la privacidad no es opcional, que la identidad no puede ser reducida a datos. Pero hay una tensión brutal: mientras el documento habla de derechos, el mundo digital opera con poder. Y el poder —cuando no está regulado— no respeta catálogos, los absorbe. Aquí está el verdadero debate: no si tenemos derechos digitales, sino si alguien está realmente obligado a respetarlos. Porque si no damos ese salto —de la declaración a la garantía— corremos un riesgo enorme: que la persona deje de ser sujeto de derechos… y se convierta, silenciosamente, en producto.
