JGR wants enforcement of the 18-month non-compete clause in their contract with Gabehart and wants to be compensated for what it feels are trade secrets that it alleges/believes have been disclosed to those outside of JGR.

@SMMHansen @bobpockrass California, North Dakota, Oklahoma, and Minnesota have near-total bans on non-compete agreements. And some the same, with the exception of when it comes to selling a business. So says my hubs who was in finance but now takes care of our 4yo daug. He negotiated all my contracts.

There are some states where non-competes aren’t legal, but North Carolina is not one of them. We know from this litigation that Chris Gabehart signed a contract with this specific noncompete and then signed a contract amendment that covered him getting 25K per weekend to crew chief the 54 on top of his regular pay if he was fulfilling that role for any other reason than a crew chief suspension. I would assume that all of his crew chief contracts with JGR also had noncompete. As I understand, he was pushing for JGR expand the number of employees that it asked for noncompete with before the breakup.

@SMMHansen @bobpockrass Interesting did not know that. All the employment contracts I've signed have all been non-compete except my first two.

@jackeymd @bobpockrass It’s already come out in litigation that Spire released Chedder Smith from his noncompete. I suspect that Rodney Childress is/was subject to a noncompete & that is why he sat out the end of last year and/or why he is working in NOAPS rather than Cup after leaving Spire mid-year.

Weekend NASCAR TV viewership is in from the Bristol races. Cup, which went against the final round of the Masters, got 1.95 million viewers. It was 2.05 million last year, so they dipped by about 100k. O'Reilly got 1.22 million viewers, up 1 million last year. Nice gain there. Truck Series race got 489k, down a tick from 498k last year.
