🚨EXCLUSIVE: Why Is TPUSA Sending Me LEGAL "Cease and Desist" Letters— They Are Back To Trying To Threaten Lawfare To SILENCE Jounalist ⚖️🚫
They can’t answer the questions, so they’ve sent the lawyers. I just received a formal Cease and Desist from SouthBank Legal on behalf of Erika Kirk and TPUSA, demanding I delete my posts and apologize for "defamation."
My response is simple: I am not backing down.
The Facts:
The Retraction: Regarding the DOJ recording—I have already issued a public correction and apology. At the time of posting, I fully believed the information to be accurate. There was ZERO malice, and under the Actual Malice Standard (New York Times Co. v. Sullivan), a journalist is protected if they believe the info was true at the time and correct the record once the error is found.
Protected Opinion: Every other post they take issue with is my protected opinion and editorial theory. In America, you cannot sue someone for having an opinion you don't like.
The Preservation Trap: Their own letter demands I "preserve all evidence" to prevent the "spoliation of evidence." I CANNOT delete my posts even if I wanted to—they are now part of the official legal record.
The Gift of Discovery: If TPUSA wants to take me to court, bring it. I welcome the Discovery process. It will finally give me the legal power to subpoena the documents and answers Erika Kirk has been hiding from the public.
To Erika and TPUSA: Thank you for the direct line of communication. I will be using the contact info provided by your counsel to ask the "legitimate questions" you claim you want to answer.
