IMPORTANT: TN governor Rajendra Arlekar has in an official Lok Bhavan release told Vijay and TVK that requisite support has not been established for him to be sworn in. Amidst contrasting precedents, one thing is CLEAR: majorities cannot be decided in Lok Bhavan BUT on floor of assembly. So why is Governor keeping Vijay waiting when no one else is staking a claim? Governor is meant to ensure govts are formed, not block their formation after an election!

@M9News_ Even if the Governor allows TVK to take oath and face the floor test, they will likely fall short. Vijay doesn't seem like someone who would poach MLAs, but the same can't be said about Congress.

One Possible Scenario: If Governor delays oath, the matter can go to the Supreme Court of India. Court may step in and order: 👉 Swearing-in first 👉 Floor test in Assembly within 24–48 hrs As per S. @LFCVijay @Ayyappan_1504 Situational discretion isn't just choosing between claimants. For instance, Rameshwar Prasad 2006 SC said Governor can't BLOCK a party. But TVK came 6 MLAs short themselves. Governor isn't blocking he's assessing viability under Article 163. That's due diligence, not obstruction

When #TVK Chief Vijay asked to form government, reports says Governor told him he must first show support from enough MLAs for a majority before the swearing-in. It would be against the Constitution. When no party has a clear majority, the single largest party should be invited to form the government and given time to prove its majority. Supreme Court clearly said that majority should be proven in the Legislative Assembly not at Governor’s residence Same incident happened bon 1996 Parliament Election & 2018 Karnataka Election

@Telugu360 For those talking about floor test, Support letters ≠ Floor test. Governor asking for letters BEFORE invite is Article 163 discretion. Floor test is proving majority IN Assembly AFTER swearing-in (Bommai 1994). TVK hasn't even been invited yet. Bommai doesn't apply here at all.

In a way, the Tamil Nadu Governor’s decision is constitutionally justified. A Governor is expected to invite a single largest party or alliance to form the government ONLY after verifying that it has the support of 50%+ MLAs through signed letters of backing.
