Nine months ago, the Supreme Court decided , affirming that parents have a constitutional right to direct their children’s religious upbringing, including opting out of instruction that substantially interferes with that right. Although the case involved LGBTQ-themed materials, its reasoning applies more broadly and is not limited to specific subjects or formal curriculum. The California Department of Education, however, maintains that allowing opt-outs from instruction involving “gender, gender identity, sexual orientation, discrimination, bullying, relationships, or family” would violate state law. It relies on a 2018 advisory from the ACLU of California, which argues that allowing such opt-outs “would clearly communicate bias against LGBTQ people,” thereby conflicting with schools’ asserted obligation to affirmatively reduce discrimination and harassment. The advisory further maintains that parents may opt their children out only where explicitly authorized by a state statute. These positions are clearly at odds with the Supreme Court’s ruling. Yet the CDE continues to maintain a webpage directing schools to refuse opt-outs. The page was updated as recently as November 24, 2025, without any substantive revision. The link to the ACLU advisory was briefly inactive, leading me to assume that it had been withdrawn following Mahmoud, it turns out the URL had simply changed. The CDE has since updated the page to restore an active link. It is striking to hear State Superintendent Tony Thurmond, who is running for governor, speak passionately about protecting “democracy” while his department openly disregards Supreme Court precedent and the constitutional rights of California parents.
