You're already prioritizing Iran's supposed "legal rights" over an American's life. Disgusting. One service member is missing. The US is searching. And you're preemptively crafting legal cover for Iran. The Geneva Conventions don't create rights for totalitarian regimes. Rights belong to individuals, not states. If Iran captures an American, the response should be overwhelming force to secure his return, not appeals to treaties that legitimize evil.

If Iran captures American military personel they are Prisoners of War and Iran is legally entitled to keep them under the Geneva Conventions until such a time as the USA makes a deal for their safe return. They are not 'hostages'.
