🟣COPYRIGHT LAW 101 for musicians: ➡️As the term suggests, copyright is the right to copy. ➡️When a person creates music or any other artistic work, they own the right to copy, distribute, adapt, display, and perform that music. This is the essence of copyright. ➡️This means the original creator of the music holds the exclusive right to reproduce or create an adaptation of the music. ➡️If any person wishes to use or adapt the music, that person has a legal obligation to secure permission from the owner of the copyright. ➡️Unlike trademarks and patents that need to first be registered, copyright exists automatically or by operation of law - particularly by virtue of section 9(1) of the Copyright and Neighbouring Rights Act. Therefore, once you create the music, you automatically own the copyright to it without the need to register it or perform any other legal act. ➡️Section 20(f) of the same law prohibits, among other things making any adaptations of the music without the express authority of the owner of the copyright. ➡️Copyright lasts for a period of 50 years in terms of section 15 of the Copyright and Neighbouring Rights Act. Thereafter, other artists are entitled to copy, reproduce or adapt the music without seeking permission. ➡️Where an artist’s copyright has been infringed, that artist has the right to sue the offending party for damages. They can also obtain an interdict which is a court order prohibiting the continuation of the unlawful use of the music. An artist can also get the music taken off a musical platform or an order for the attachment of any infringing copies of the music. These remedies are provided for in section 52 of the Copyright and Neighbouring Rights Act and in the common law.

🟣You are missing the point. Jah Signal didn’t just sing the Bible verse. He *sampled* Pastor Charamba’s song. Anyone who listens to it can see that it’s an adaptation of Pastor Charamba’s song. Sampling is when you reuse a portion of someone else’s sound recording in your recording. A sample is not just the words. It normally comprises of more elements such as rhythm, melody, speech, sound effects or longer portions of music. The sample can be layered, equalized, sped up or slowed down, repitched, looped, or otherwise manipulated. At the end of the day it is still an adaptation of another artist’s work and therefore a breach of section 20 of the Copyright and Neighbouring Rights Act. If an artist sings something as generic as “I will always love you” - a common sentence in romance, if they take the melody, rhythm and other musical effects of someone else’s song, they are in breach of copyright.
