DC has a "Code" passed by the DC City Council and the Superior Court is where these Code violations are prosecuted. BUT, Jonathan, the two courts -- Superior Court and U.S. District Court -- are a block away from each other. Both courts use the same juror pool, and the prosecutors in both courts are Assistant U.S. Attorneys from the same U.S. Attorneys Office. In fact, many of the AUSAs who prosecuted J6 cases were assigned to the Superior Court side of that office, and not the District Court side. All have the same boss -- the U.S. Attorney for DC. The 65% conviction rate is a calculation of both offices combined, and has been that number or a very long time. This issue was widely debated in motion for change of venue in DC cases -- I filed a few of them -- and it was during the argument of one such motion that Judge McFadden asked AUSA Paschall about the J6 conviction rate -- only about 6 jury trials at the time (summer 2022) -- compared to the Office's historical conviction rate. Why would he have known to ask that question? Maybe because Judge McFadden, prior to becoming a judge, was a Deputy Assistant Attorney General in the Criminal Division, and that branch of DOJ tracks those statistics nationwide.

If you had a fair jury pool you would have seen some instances of juror skepticism about the way the evidence was presented. Remember I had 4 jury trials. The DC jurors listened and accepted uncritically every statement uttered by an FBI Agent, and simply ignore cross-examination and the testimony of any defense witnesses. They could not have been any less interested. The cases were over before the started. Some DC residents WANTED to be on those juries because they WANTED to vote to convict before the trials even started.
