Opinion: Mislabeling Gaza as “Genocide” Undermines the Truth In his column, Shadi Hamid argues that Israel’s war in Gaza should be labeled “genocide.” It is a serious accusation, but one that does not withstand legal or analytical scrutiny. The central problem is intent. Under the Genocide Convention, genocide is not defined by the scale of death or destruction alone. It requires a demonstrable intent to destroy a people, in whole or in part, as such. That threshold is extraordinarily high and deliberately so. It is meant to distinguish genocide from even the most brutal forms of warfare. Israel’s stated objective has been the destruction of Hamas, the militant organization that carried out the October 7 attacks and continues to operate from within densely populated civilian areas. Hamas embeds its fighters, weapons, and command infrastructure in homes, schools, mosques, and hospitals. This reality does not absolve Israel of responsibility, but it fundamentally shapes the nature of the conflict. Civilian casualties in such an environment, while tragic, are not in themselves evidence of genocidal intent. Hamid’s argument leans heavily on casualty figures and the scale of devastation in Gaza. But numbers alone cannot establish genocide. If they could, many modern conflicts would qualify. The law requires proof of a coordinated plan to eliminate a protected group. That evidence has not been demonstrated. He also points to inflammatory statements by individual Israeli officials. Some of these remarks are indeed troubling and deserve criticism. But rhetoric, even reckless rhetoric, is not the same as state policy. Genocide is not inferred from isolated quotes. It must be grounded in systematic actions aligned with a clear intent to destroy a people. There are legitimate and serious debates to be had about Israel’s conduct in Gaza, including questions of proportionality, humanitarian access, and potential violations of the laws of war. Those debates should be pursued rigorously. But collapsing all of these concerns into the single, most extreme charge available risks distorting both the law and the reality on the ground. Labeling the war in Gaza as genocide may carry rhetorical force, but it weakens the precision of a term that was created to describe humanity’s gravest crimes. If everything becomes genocide, then nothing is.

What Israel has done in Gaza clearly and easily meets the legal definition of genocide as described in the UN Genocide Convention. I lay out the case in detail here in @washingtonpost: washingtonpost.com/opinions/2025/… Words have meaning. Even if it offends some people, we need to call things as they are. The idea that Israel is somehow immune from judgment is itself an application of a double standard. It is anti-semitic to hold Israel to a different standard than other states. And that's what Israeli is: a state. Sometimes, states do really awful things. And to conflate American Jews with the Israeli state is yet another example of anti-semitism, which the AJC seems to be doing here.
