The current broad interpretation of the 14th Amendment's birthright citizenship clause is not optimally suited for the United States in the 21st century and should be narrowed to exclude automatic citizenship for children of "sojourners". It creates real, documented problems that undermine national sovereignty, the rule of law, fiscal sustainability, and security, especially amid high levels of illegal immigration and global mobility.

Just because that is the position of the Administration does not mean that SCOTUS will agree. In fact, I listened to oral arguments and even some of the conservative Justices telegraphed that they are skeptical of the Administration’s argument. As a lawyer, IMO “subject to the jurisdiction thereof” does not require “domicile”, which btw is not contained in 14A. The Administration is arguing for words that do not exist in 14A.
