the critical issue at this trial was KF's state of mind and its impact on her actions: was she a despondent woman who overwhelmed with grief and trying to commit suicide vs. an unhinged, angry lunatic who intended and actually tried to commit murder. And with those stakes and the defendant testifying, the prosecutor did not even attempt to challenge the defense theory. He didn't even try to use facts and circumstances to press KF. Her testimony is unimpeached. Instead he clumsily (and with a pissy tone) tried to defend Noonan as generally competent. In other words, the DA completely capitulated. No judge will dismiss all of KF's testimony and credit all of Noonan's, especially given the statements of KF and Noonan that came into evidence. Nor will there be any rebuttal case to the defense case.When you bear the burden of proof, you kind of have to try to poke holes in the defendant's testimony and the defense case...
