But when Congress enacted FOIA, take a wild guess who they excluded: Congress, of course. Just like they exempted themselves from the Affordable Care Act, insider trading, Lobbying Disclosure Act. We also know they exempted themselves from the Ethics in Government Act.

I fell for XRP BS for years! Funny images, Random accounts which people think they are in the know, worshiping CEOs like they know something they can't say etc. The Psyop is very very strong. I will stick with it as an investment perspective as it fits my strategy and thats that. I came into the space to make money and that's what I will continue to do. We keep it moving.

We know the same argument equally applies to buying #BTC Guess what the SEC lawyer said about buying #Bitcoin - and why it’s not a security? He said #BTC doesn’t have a network. SEC enforcement lawyers are not that stupid. They just lack integrity. It’s as if they “lack a faithful allegiance to the law.”

If the SEC, during the Howey oral argument, had told the Sup. Ct. that folks were investing in an “ecosystem of oranges” they would have been summarily thrown out of the courtroom. The SEC has strayed so far from the law it would be laughable if it weren’t so sad and damaging.

It was, to me, the most ridiculous thing SEC lawyers uttered at the hearing. But, then again, if there’s one thing I’ve learned about SEC lawyers, it’s that they absolutely refuse to let the truth get in their way.

Adjourned. The @SECGov's summation of its argument (broadly) is that @coinbase is making up a new version of the Howey Test and that there can be no deviating from Howey as it was originally written. The SEC lawyer said "The Congress of 1934 would be surprised that today there would be such an easy workaround to the carefully constructed regulatory structure they created in 1934 with regards to the market." Coinbase contends that the SEC has failed to prove that the twelve issuers of the tokens in question made any statements or actions that could be interpreted as engaging in a contractional obligation with Coinbase customers and the SEC is engaging in regulatory overreach by stretching the Howey Test to fit the circumstances. The Coinbase lawyer said: "I think there would have been a lot of surprise in the 1933/1934 Congress to find an investment contract didn't have anything to do with a contract at all. The Commission's complaint draws the court into completely unprecedented territory. The SEC should follow enforcement and rulemaking actions that make sense of statutory language and doesn't twist it upside down. This is several bridges too far and for that reason we ask you to dismiss completely." Failla closed by making it clear she was not going to rule from the bench and for both parties to take that "as the compliment that it is."

The SEC lawyer then tries to somehow undermine the question three times - then out comes Hinman has discussed XRP securities status with the Financial Stability Oversight Committee. Ripples XRP Sales and Buybacks since June 30 2023 511’694’077 XRP were sold for an average price of $.57 making a total of $291’665’623 or roughly $49 million per month of net-sales.
