As a former DUI Prosecutor I can tell you that they will have a tough time convicting him of DUI under the facts I’m hearing. In Florida the State can offer to reduce the DUI down to Reckless Driving on cases that are weaker. These plea offers usually still require DUI sanctions as conditions of the probation.
