Lee became irate when a homeless man used a water cup to get soda. The man allegedly threw soda at Lee and the manager, prompting her to retrieve a gun from her car. Lee fired three shots at the man in his car in the parking lot. She missed him but struck bystander Alejandro Ramirez Santos in the head. Santos was hospitalized in critical condition but expected to recover. Lee was arrested and charged with assault with a deadly weapon with intent to kill and discharging a firearm into an occupied vehicle.
