In Europe, DAC8 has turned “Know Your Customer” into “Kill Your Customer.” Today, Bull Bitcoin is officially opening the first legal front against DAC8. We have brought a case before France’s Conseil d’État, the country’s highest administrative court, to strike down the decree implementing DAC8 in French law. Since January 1, 2026, DAC8 has required crypto-asset service providers to systematically collect user and transaction data and subsequently report it to national tax authorities. These authorities will automatically exchange this information across the European Union and with tax administrations in other participating countries around the world. The result is a massive international financial-data honeypot linking people’s legal identities, home addresses and crypto activity, including information with no relevance whatsoever to taxation. This is grossly disproportionate and poses a serious threat to the physical safety of crypto holders and their families. Until now, most customer data remained within each crypto-asset service provider unless a suspicious transaction was reported or a competent authority made a lawful request. DAC8 replaces this model with the systematic reporting and cross-border sharing of highly sensitive financial information. The more authorities, civil servants, contractors, systems and foreign jurisdictions that have access to this data, the greater the risk that it will eventually be leaked, stolen, illegally accessed or sold to criminal organizations. At the same time, kidnappings and violent attacks against crypto holders and their families are rising, with leaked personal and financial data increasingly being used to identify and target victims. France has already suffered numerous breaches of highly sensitive government and financial databases. Given enough time, a database of this scale is almost certain to be breached. When that happens, criminal organizations will gain a ready-made map of who to target and where to find them. This is not responsible financial oversight. It is a recipe for disaster. We filed our initial application before the Conseil d'État on February 24, 2026, followed by a substantive legal brief setting out the full grounds of our case. This is not a symbolic gesture. It is a serious legal action, grounded in law and handled by experienced legal professionals. We are seeking the outright annulment of the French decree implementing DAC8’s crypto-asset reporting regime, on the grounds that automated mass financial-data collection violates fundamental human rights. If necessary, we are prepared to take this fight before the Court of Justice of the European Union and the French Constitutional Council. A victory in France could establish an important judicial precedent and provide a blueprint for other European actors seeking to fight DAC8 in their own countries. En Europe, DAC8 a transformé le “Know Your Customer” (KYC) en “Kill Your Customer”. Aujourd’hui, Bull Bitcoin ouvre officiellement le premier front juridique contre DAC8. Nous avons saisi le Conseil d’État, la plus haute juridiction administrative française, afin de faire annuler le décret transposant DAC8 en droit français. Depuis le 1er janvier 2026, DAC8 impose aux prestataires de services sur crypto-actifs de collecter systématiquement les données d’identité et de transaction de leurs utilisateurs, puis de les transmettre aux autorités fiscales nationales. Ces informations seront ensuite automatiquement partagées avec les autres pays de l’Union européenne, ainsi qu’avec certains pays de l’OCDE. Concrètement, DAC8 revient à constituer un immense fichier international de données financières reliant activité crypto, identité civile et adresse personnelle. C’est gravement disproportionné et cela représente une menace sérieuse pour la sécurité physique des détenteurs de crypto-actifs et de leurs familles. Jusqu’à présent, la plupart des données clients restaient au sein de chaque prestataire de services sur crypto-actifs, sauf en cas de déclaration de transaction suspecte ou de demande légale émanant d’une autorité compétente. DAC8 remplace ce modèle par une déclaration systématique et un partage transfrontalier de données financières extrêmement sensibles. Plus ces données sont accessibles à un grand nombre d’administrations, de fonctionnaires, de prestataires, de systèmes informatiques et de juridictions étrangères, plus le risque qu’elles soient un jour divulguées, volées, consultées illégalement ou revendues à des organisations criminelles augmente. Au même moment, les enlèvements et les attaques violentes visant les détenteurs de crypto et leurs familles se multiplient. Le ministre de l’Intérieur a déclaré que 77 faits d’enlèvement, de séquestration, d’extorsion ou de tentative liés au secteur crypto avaient été recensés depuis janvier 2026. Dans la plupart des cas, des données personnelles et financières issues de fuites ont permis d’identifier et de localiser les victimes. La France a déjà connu de nombreuses fuites touchant des bases de données gouvernementales et financières hautement sensibles. Avec autant de points d’accès, une base de données aussi massive finira presque inévitablement par fuiter. Une fois compromises, ces données pourraient permettre à des réseaux criminels d’identifier les détenteurs de crypto-actifs, de les localiser, puis de les cibler directement. Un tel dispositif ne relève pas d’un contrôle financier proportionné. Il crée un risque systémique pour la sécurité des citoyens. Le 24 février 2026, nous avons déposé une requête sommaire devant le Conseil d’État, suivie d’un mémoire ampliatif développant l’argumentaire juridique de fond de notre recours. Ce n’est pas un geste symbolique. C’est une action juridique sérieuse, fondée en droit et menée par des professionnels expérimentés. Nous demandons l’annulation pure et simple du décret français mettant en œuvre DAC8, au motif que cette collecte automatisée et massive de données financières représente une atteinte disproportionnée au droit à la vie privée. Si nécessaire, nous sommes prêts à porter ce combat jusqu’à la Cour de justice de l’Union européenne et au Conseil constitutionnel français. Une victoire en France créerait un précédent judiciaire important et donnerait aux autres acteurs européens une base solide pour attaquer DAC8 dans leur propre pays.
