CMPAC is deeply concerned by the manner in which Bill C-9, the Combatting Hate Act, has been pushed through the Standing Committee on Justice and Human Rights without sufficient debate or proper deliberation. As a result, a bill with serious consequences for religious freedoms and civil liberties is being rushed in parliament. The decision to move Bill C-9 forward in its current form risks further eroding trust between the federal government and Muslim communities across Canada. The outcome of the committee process sends a troubling signal that the concerns of the Muslim community were not taken seriously. Legislation introduced in the name of protecting communities must be crafted with those communities, not advanced in a manner that sidelines their concerns. Protecting communities from hate and protecting fundamental freedoms are not competing objectives; they are mutually reinforcing. People are safest when they can worship freely, speak openly, protest peacefully and trust that the law is applied fairly. Bill C-9 can help address genuine hate. But unless it is drafted with discipline and enforced with accountability, it risks expanding state power in ways that weaken democratic trust. The Canadian Muslim Public Affairs Council (CMPAC) is disappointed with Prime Minister Carney’s statement on the US - Israeli military strike on Iran. The Prime Minister’s statement highlights Canada’s criticisms of the Iranian government and provides impunity for Israel’s continued transgressions, stopping short from addressing the core legal issue: The US - Israeli strike against Iran constitutes a violation of the prohibition on the use of force under Article 2(4) of the United Nations Charter. The US - Israeli military strike against Iran is a violation of international law. The prohibition on the use of force under Article 2(4) of the United Nations Charter is a binding treaty law and a cornerstone of the post-1945 legal order. Force is lawful only where authorized by the UN Security Council or exercised in self-defence in response to an armed attack pursuant to Article 51. An unprovoked unilateral, pre-emptive strike absent of demonstrable imminence falls outside these narrow exceptions. The Charter further obliges states to resolve disputes by peaceful means. This military assault took place while negotiations were ongoing between Iran and Israel, undermining the Charter framework and destabilizing the region further. At the World Economic Forum in Davos, Prime Minister Mark Carney called for a defence of a rules-based international order and cautioned against a system in which powerful states exempt themselves from the rules when convenient. That standard must apply consistently. Canada cannot credibly uphold a values-based foreign policy while aligning with conduct that contravenes the Charter’s core prohibition. There can be no exception based on geopolitical alignment with the US or based on legitimate criticism of the Iranian regime for their oppression of the Iranian people. Prime Minister @MarkJCarney should instead call for an immediate cessation of all hostilities, sustained de-escalation and the protection of civilians in the Middle East. Further expansion of aggression risks regional spillover and significant civilian harm. International humanitarian law obliges the prevention of harm to civilian populations. The humanitarian civilian death toll is rising; The US - Israeli strikes struck civilian targets including girls’ schools killing over 50 children, and Iranian missiles also bombarded civilian neighbourhoods across the Middle East.
