Even the greatest of statesmen cannot construct a political system that runs on autopilot forever. No written constitution, no matter how brilliantly written or excellently maintained, can perpetuate itself forever or “solve” politics forever. At best, you can defer existential political questions for an extraordinary amount of time. But eventually, someone has to step outside the existing rules and decide again, just like someone else did before anything was put to paper. The irony is that when I say things like this, the usual suspects will come in and accuse me of “fascism”. But everything I just described is exactly what the Founders themselves did in Philadelphia in 1787. Every single political order, including our own, ultimately rests on a foundation that simply cannot be justified by a bunch of rules that come only after it’s set up. At some point, what we call “legitimate political authority” has to be seized and asserted. It doesn’t come from an existing political rulebook forever. The Constitution itself exists because the Founders did this. They stepped outside the existing legal framework to create a new one based on their own personal decisions. Were they fascists for doing this? Were they tyrants? Authoritarians? Or were they simply statesmen engaged in a political project that we now celebrate nearly a quarter of a millennium later?
