Yes, Unvaxxed NYC Teachers and Principals Can be Reinstated to Work Without Signing a Legal Waiver There was some confusion at the DCAS hearing yesterday. As many of my followers know, DCAS held a virtual meeting yesterday (11-19-25) to discuss a rule change to allow fired unvaccinated workers to return to our jobs without signing a legal waiver. Because the DCAS meeting did not apply to teachers and principals, many assumed the reinstatement process must not apply to these positions either. This is false. Teachers and principals are eligible for reinstatement without signing a legal waiver, just as all other city positions are eligible. I confirmed this by emailing UFT general counsel Beth Norton, who promptly replied to me with the following response: DCAS does not have jurisdiction over pedagogues. There are specific rules for civil service employees that must be adhered to or properly waived by the agency. That is what this hearing was about. Teachers have had the opportunity to return to service at any time since the vaccine mandate was lifted. This was not true for civil service employees. With regard to the waiver that was previously part of the rehire process, that will not be required of pedagogues during this open window. I would encourage anyone who wants to return to service to submit their interest to the following email before December 5. NYCPSServicereturn2025@schools.nyc.gov More Questions? In addition, Phyillis Inserillo emailed 16 questions to DCAS that we all compiled and received answers from them yesterday just before the hearing began. Virtual Public Hearing on Reinstatement of Fired Unvaccinated NYC Workers 11-19, 10am On Wednesday, November 19 at 10am there will be a virtual meeting to determine if a rule change will be approved allowing for the reinstatement of “dismissed” unvaccinated NYC workers. City Hall has told multiple reporters (including GOTHAMIST) if an unvaccinated worker is reinstated through this process they will not have to sign a waiver of their legal rights to get their jobs back. This is a very promising development, but we are watching everything very closely. The meeting will be held on MICROSOFT TEAMS. There will not be an in-person meeting so no one should physically go to City Hall, and there will be no rally or public action as all fired-worker leadership will be remotely logged into this meeting. We strongly recommend everyone potentially impacted logs into this meeting to watch what happens for themselves. We will have summary and analysis of what transpires later in the week. Disgraceful that Americans with integrity and courage are being treated like this. @ericadamsfornyc is pulling the same nonsense in NYC with Cops, Firefighters, Teachers, EMT’s etc. How hard is this ? People were wrongfully terminated and forced from careers under threat of termination. These people were denied Due process and first amendment protections. Everyone affected should be reinstated & compensated as if this never happened with an apology issued. You have money for illegals & foreign nations but not for those who served this country honorably and upheld their oath. Instead you reward cowards who turned a blind eye to this grave injustice. Got my COVID reinstatement decision back. I will not be accepting. Commanders can break the law and get promoted, but we have to fight to even COMPETE for a promotion to a rank we should already have. The terms they want me to accept? Reinstatement to O3 (I should be an O4 getting ready for my O5 board) with an opportunity to compete for O4 after I’m reinstated via SSB… 4 years behind my peers. Oh and in order to get backpay and come back 4 years behind my peers? I have to accept a 4 year service commitment with NO guarantee I’ll ever promote. But they’ve given me a “consolation prize” option to retire as an O3 if I do 20 years and don’t manage to promote. Break the law? promoted. Mental illness? Double separation pay. Do the right thing? they will make your life hell. Another humiliation ritual they want me to perform. Not just 4 years behind my peers but they want me to come back in a rank LOWER than people I have supervised 🤣. Seriously- people I’ve supervised are O4’s and they want me to come back as an O3 and hope that the SSB will promote me. Who would agree to this?! Do I recommend others go through this process? No; not if you’re going through the Air Force. And not if you have PTSD from all of this. I don’t think a single DAF person going through reinstatement has accepted the terms they’ve been offered. Because they are terms likely developed by a team (no one knows who is on) of people who had a hand in kicking us out or were apathetic. At least with the army and navy we know that the people on the team UNDERSTAND the abuse we went through- because they too went through it. Just more anxiety and PTSD. Went through a year of waiting for an answer and a MEPS humiliation ritual for nothing. Everyone who told me this would happen…congratulations, you were right.

Our signal got cut. At NYC Bd of Elections. Pete Homberg, Manager, refused to give Athena Clarke her file which is hers by law. He refused to accept my voter requested trigger of a 3 per cent hand count. Eric Butkowski, lawyer for Bd of Elections, who refused to give us his contact info per the front desk, refused to confirm that the ‘audit underway’ would be a hand count. Pete Homberg erupted eventually and fled, refusing to answer my or Athena’s questions why Mamdani was allowed to appear 2x on the ballot (in two parties) and Athena was forbidden to do the same. No one will give Athena her records or take my voter-initiated audit required by law. No one will see us says the front desk. ‘Too busy.’
