@lucernesulk @foreverimbetter She didn't order boiling water, she ordered a coffee which, by both consumer expectation and by law, is supposed to be around 140 degrees.

@Cleargummybear2 @foreverimbetter The only liability is yourself. The properties of boiling water are not dependent on who boils the water. The consequences for spilling the drink remain the same. If McD's is liable for the burns, should they also be liable for dry cleaning when you fumble an iced drink?

So a teenager was drinking multiple energy drinks a day and died so the family is suing the energy drink company? Are parents ever gonna realize that parenting is their job?

@lucernesulk @foreverimbetter What? You changed the actor in the situation, the one who created the dangerous situation. So yes, that obviously changes liability. Lol

@Cleargummybear2 @foreverimbetter Nah, you're so right. When I make myself tea at home I have to boil the water, and if I spill it on myself it's scalding, and I will get third degree burns. But somehow if I simply change one variable: buying it at McD's, it's now the company's fault. Cease respiration.

@aspire_2more @AesPolitics1 @EiratheIntern @jamesdoe1912 Well you can look at tons of charts centered on quality of life economically in the US and see that every one starts going to hell in the 90's. Subsequent presidents definitely didn't do enough to stop it, but that doesn't absolve Reagan of responsibility.

@AesPolitics1 @EiratheIntern @jamesdoe1912 Based on what evidence that is directly tied to Reagan? There have been many presidents and congress control of both parties since then? You won’t answer because there isn’t an argument

@quasiSnarkX @foreverimbetter There's really no helping you if you think it's in any way defendable to serve coffee at near the boiling point after repeatedly being warned not to.

@Cleargummybear2 @foreverimbetter It's a textbook case because corporations have to deal with reality so they know these kind of lawsuits are a threat they have to avoid. However, the idea that the restaurant shouldn't serve coffee hot because of clumsy customers is wrongheaded.

@QondiNtini That was very clearly a statement on societal misogyny. It was a great joke. Misogynists were the butt of the joke, not Harris.

@quasiSnarkX @foreverimbetter It's not. It's the opposite. It's literally the textbook case of gross corporate negligence. Law schools teach it today. McDonald's had absolutely no defense in that case.

@foreverimbetter @Kenyonegus No I'm not arguing that at all. You're that these cases where there is clear negligence are not worthy of lawsuits with the entire American legal system and almost all case law disagrees with you. Windex comes in a bottle that's difficult to open. Guess why.

@Cleargummybear2 @Kenyonegus I didn’t say no children did that, you just want to argue that people should be suing for anything. There are legitimate cases to sue corporations, just as there are tons of nonsense suits. Even in the case of toddlers getting into the tide pods there’s parental responsibility

@_trash_void @greenmelonstudi @foreverimbetter McDonald's. She was properly holding the cup in a parked car and removing the lid to add sugar (which is a proper use of the cup) when it lost its structural integrity because of the temperature of the coffee.

@foreverimbetter @Kenyonegus No, the first actions that established the class action basis were for children mistaking them as either candy or teething products. You have such a strong defense of a corporation yet have absolutely zero idea of the facts. I've attached an image from a firm managing the cases.

@Cleargummybear2 @Kenyonegus No part of me saying a knee jerk reaction to sue is defending a corporation but you seem intent on saying expecting any level of personal responsibility means it’s corporate defense. On top of that it was teething aged children eating the pods, it was fucking teenagers.
