To the Leaders of the State of Tennessee, Members of the Legislature, and Citizens Across America: We are calling upon the State of Tennessee to introduce and pass “Gary’s Law,” inspired by the case of Gary Wayne Sutton. This legislation would establish stronger protections in all death penalty cases and ensure that no person is sentenced to death without undeniable, transparent, and fully disclosed evidence. When the government seeks the ultimate punishment, the burden of proof must be absolute. No individual should face execution based solely on circumstantial evidence, assumptions, inconsistent testimony, or incomplete investigations. A death sentence should only be pursued when guilt is supported by clear factual evidence that leaves no reasonable doubt. Under “Gary’s Law,” the State would be required to provide and disclose all evidence connected to a case, including: • DNA evidence, testing results, and forensic findings. • All investigative reports, witness statements, and physical evidence. • Any exculpatory evidence that may support innocence or create reasonable doubt. • Complete transparency regarding forensic testing procedures and expert conclusions. • Independent review of disputed DNA evidence or conflicting forensic findings before a death sentence can proceed. • Verification that all available scientific testing has been completed prior to conviction or execution scheduling. Gary’s Law should also require that any conviction carrying the death penalty be supported by substantial non-circumstantial evidence and scientifically reliable facts. If DNA, forensic evidence, or key findings are inconclusive, disputed, missing, or withheld, the State should not have the authority to move forward with an execution. Justice must be rooted in truth, transparency, and accountability. In cases involving life and death, every fact matters, every piece of evidence matters, and every unanswered question matters. We urge the State of Tennessee to take a stand for justice reform and human rights by proposing and passing Gary’s Law. The people deserve a justice system that values certainty over assumption and truth over expediency. The nation is watching, and the demand for fairness, transparency, and accountability has never been louder.

The scheduled execution of Garywayne Sutton on December 3rd cannot move forward under the shadow of systemic failure and unanswered questions. The public deserves assurance that every conviction has been thoroughly examined, every piece of evidence properly reviewed, and every constitutional right protected. Many Americans believe Tennessee failed to adequately review DNA evidence in Tony Carruthers’ case. When doubt exists especially in cases involving irreversible punishment the responsibility of the state is not speed, but certainty. We are also calling upon the Tennessee Supreme Court to intervene, override this case for immediate judicial review, and examine whether constitutional protections, evidentiary standards, and due process rights were fully upheld before this execution proceeded. Justice cannot exist where transparency is absent. Justice cannot exist where evidence is questioned. And justice cannot exist when the people no longer trust the system meant to protect them. This is bigger than politics. This is bigger than one case. This is about the integrity of the American justice system itself. An innocent man’s life is on the line, and a fraudulent conviction must be overturned. We need advocates. Gary is a native of Sevier county Tennessee. We are asking for the truth be shown and for Tennessee to do the right thing. Gary Wayne Sutton has fiercely maintained his innocence on Tennessee's death row for over 30 years. The state has scheduled his execution for December 3, 2026. The official case files state the facts clearly: there is absolutely no DNA, no fingerprints, and no physical evidence linking Gary to this crime, We have the documents we see the truth. Instead, Gary was convicted in 1996 based almost entirely on the bogus scientific testimony of Dr. Charles Harlan, the state’s former chief medical examiner. Dr. Harlan was a thoroughly disgraced official whose medical license was permanently revoked in 2005 after the Tennessee Board of Medical Examiners found him guilty of 18 counts of gross incompetence, malpractice, fraud, and deceit. During the trial, Dr. Harlan fabricated a timeline for the victim's time of death using organ slides a method multiple independent, reputable pathologists have since stated is a scientific impossibility. When the victim was found, the body was in full rigor mortis, meaning it is scientifically impossible for the crime to have occurred when the prosecution claimed. The state's case is built entirely on junk science from a discredited doctor. We are urgently calling on grassroots advocates, legal organizations, and Governor Bill Lee (@GovBillLee) to look closely at the facts, acknowledge this fatal flaw, and intervene to halt this execution. The Sutton family also desperately needs immediate legal reinforcement.
