His entire argument hinges on "the night of arrest" language the defense used in a motion. He insists that this means the 11th. The filings are at best ambiguous on the timing of the formal arrest because the booking sheet says one thing and the PC affidavit another. The 12th reconciles with all the public information about the surrender and the timing of the Discord confession; the 11th contradicts it all. He continues to insist it's the 11th despite being corrected by a Washington County Prosecutor that it was the 12th, now apparently relying on unfounded community gossip to support his position. Why cling to it? Because they *need* chaos in this case to get people worked up and if Tyler sat in WA County until Utah County showed up, was transported to Utah County and booked in, taken to court, and Mirandized when he was sat down for an interview that evening, then the timeline fits perfectly with Sheriff Brooksby's account and Tyler sending the Discord confession message right before he turned himself in on the 11th, exactly as the message says. Also worth observing is the stratospheric arrogance you have to have to think you've figured out a case-breaking fact from something the defense said that the defense didn't know about despite the defense having massive informational asymmetry about the case and 2 of the best capital defense lawyers in the country on the team (Kathy doesn't make this list). The exact timeline of Tyler's surrender, arrest, and attempted interrogation will absolutely be covered in the preliminary hearing and will show everyone who is good at calling the shots in criminal cases and who isn't.
