Craig Baird - Canadian History Ehx
Today marks the anniversary of the enactment of the Statute of Westminster in 1931. The Statute of Westminster was a landmark document in Canada's history that is sometimes referred to as Canada's Declaration of Independence. This is the story. After Confederation in 1867, Britain still held a great deal of control over Canada's affairs. Treaties were negotiated by the British on Canada's behalf, often without Canadian input, and Governors General of Canada represented the government of the United Kingdom. During the First World War, soldiers from Canada, Newfoundland, New Zealand, Australia, and elsewhere fought bravely on the battlefield. In Canada, there was a greater push for nationhood and more autonomy. In 1922, Prime Minister William Lyon Mackenzie King refused to help British forces in Turkey without approval from the Canadian Parliament. A year later, Canada signed its first treaty (the Halibut Treaty) with the United States without British involvement. In 1926, Canada established an embassy in Washington, DC and Vincent Massey (later the first Canadian-born Governor General) was named Canada's first diplomatic envoy to a foreign capital. Things began to change even more with the Imperial Conference of 1926. The Balfour Report, released earlier that year, declared Britain and its Dominions were equal in status. By the Imperial Conference of 1930, changes to the legal systems of the dominions like Canada were initiated. The Statute gave Dominion legislatures the power to make their own laws even if it violated colonial policy. It also allowed for the Supreme Court of Canada to be the final court of appeal replacing the Judicial Committee of the Privy Council in London. The federal and provincial governments couldn't agree on how to make future changes to the BNA Act. So, the British Parliament retained power to amend the Canadian Constitution, which remained until the Patriation of the Constitution in 1982. Each Dec. 11, the signing is celebrated in Canada as a major part of Canada's move to autonomy. On Dec. 11, the Royal Union Flag (Union Jack) is flown along with the Canadian Flag on federal buildings, airports, military basis and elsewhere.
