Prosecutions turn on the specific facts of each individual case. The same phrase or manifestation or expression might be used, but... Was the context such that an objective person -- in the context of the different circumstance -- have believed it to be a "true threat?" Did the defendant subjectively understand that third parties would, because of the circumstances, reasonably perceive the message as a "true threat." Those questions are different in every case based on the facts unique to each. Don't be stupid because the press is stupid.
