BREAKING: Police fatally shoot unidentified man in Madison, Wisconsin. According to witnesses, the man was shot in the head three times by police. The video of the shooting was posted by Richard Hegwood, who lives in the neighborhood, to his Instagram. “They catch the dude, they have him on the ground, he’s struggling, he’s struggling to get up, and that’s when they shot him, they shot him three times,” Hegwood told Wisconsin Public Radio. “I never saw a weapon, he never brandished a weapon.”

#Waukesha County Sheriff Capt. Nick Ollinger, who is running for sheriff against John Gscheidmeier, just called me and said he wanted to weigh in on the #Madison police shooting and the statements by #Democrat governor candidates David Crowley and Francesca Hong (the latter called the shooting an "execution" even though the Madison police chief said the firing officer was injured by a knife-wielding Corey Ruiz before shooting - you can see the weapon in the video after an officer places it to the side.) "They're condemning the officer before knowing the facts," Ollinger said. "Based on the video evidence that we can see, based on my training and experience, based on what the chief has said, this appears to be justified," Ollinger said. "But we have to gather all of the facts. But what we are presented with today, it appears to be justified." I asked him to explain why, and he said, "The weapon, intent and delivery system. The individual from what I can see was being taken into custody. He presented a weapon which was the knife. He had the intent because he ended up cutting the officer and he delivered the knife into the person. From my training and experience, the officer would be justified." He explained that the law holds lethal force justified when there is "the intentional use of a weapon or firearm that can cause death or great bodily harm to you or another person or persons. You have to have the justification there. The officer will have to bring this out as to why he felt that way." Added Ollinger: "We have two governor candidates coming out, one calling it an execution before we have all the facts. That right there is why we have recruitment and retention problems. We have individuals who don't have all of the factual information. This officer went out to protect the citizens of Madison. They were attempting to take someone into custody and that individual presented a weapon and ended up injuring the officer." Asked what he thinks the consequences of politician' incendiary statements can be, he said: "We have seen it. I was there in Kenosha. We see what happens. I was there protecting the citizens of Kenosha on the court steps for days while citizens were burning the city." He was "commanding our civil disturbance unit." If John wants to call and offer his reaction, I will publish that too. He knows where to find me. I think more law enforcement voices speaking out in these situations, and sharing their perspective from their experience and training (as Jim Piwowarczyk also did tonight) is very important. We usually just hear from the politicians at the early stages of these situations, and sometimes cities burn.

#BREAKING Two sources in a position to know tell WRN that the man shot by police in #Madison today is Corey D. Ruiz (Corey Durell Ruiz). Part of the scene was captured on viral video. I have now seen a second, much clearer video. It shows: -"he's got a knife! He's got a knife!" an officer appears to shout. This appears to be the officer who fired his gun. -"Taser, taser" an officer says -Then gunshots ring out -It looked like they were possibly trying to cuff him but hadn't managed to, there was a struggle... there are multiple officers there. It's an ugly video. I will put it in the comment thread. You hear the clicks of the taser. Then: It looks like he's down on the ground when the officer fires. This is probably going to blow sky high. Misdemeanor: Battery 2013: Misdemeanor convictions: 2 counts of theft 2009: Felony convictions: Strangulation/suffocation (2 counts), robbery with force, 2007: Misdemeanor conviction: Disorderly conduct The legal test will revolve around whether the officer(s) had a reasonable belief of imminent death or great body harm to themselves or another when opening fire... and his past record isn't relevant, unless they knew it, and it played a part in their formation of belief. The video is disturbing. As with all of these things, it's smart to wait for all facts and angles, including from the officers' angles before making judgments. Remember how bad the Jacob Blake video looked, and that officer was exonerated due to the fact Blake had a knife and twisted toward him. These are the facts we know now. But the video is very disturbing. These situations are fluid and this just happened, so details can always change and there's information not known. The fuzzier video shows he may have made contact with, or came close to making contact with, an officer, but a car then moves in front of the camera right as the shots ring out. But this is the information known at this time from credible sources who are in a position to know. #breaking #breakingnews #police #madison
