Next chapter in Tornetta case 👩‍⚖️ Oh my, plaintiff's attorneys now feeling the heat, too. Thank you to all of you who are helping to make retail shareholders heard. You are all making an important difference. Plaintiff's attorney filed today a "Reply Brief in Further Support of Application for An Award of Fees and Expenses", where they propose an alternative way of looking at their fees. Remember, it was initially 29.4 million $TSLA shares (today roughly $5.4bn). They still want that (and argue so on 49 of the 54 pages), but on pages 50 to 53 then, "to be helpful (😂) to the Court, Plaintiff includes herein a cash-based alternative structure the Court could consider were it to grant something other than shares." They feel that stock is fluctuating, and has lost 30% of its value this year (ohhh,😢), they "acknowledge the requested award, if granted, would be record-setting and the subject of significant commentary." So they propose to be alternatively remunerated at $73,948/hour, which would amount to a "low-end cash award of roughly $1.44bn". Document here: plainsite.org/dockets/downlo…

🧵We’ve been receiving a lot of media interest from our adventures with the Cybertruck. Especially this past week between King Of The Hammers, towing our Pikes Peak race car, racing the Cybertruck in Baja mode at TeslaCorsa Buttonwillow, and in between daily driving it. That’s a lot! We’ve had a blast, clearly! Rather than replying to the many inquiries, we’d prefer to share our story here with whoever might be interested. We love that the media is excited about the Cybertruck, as they should be; we are, too! However, we’ve witnessed some misinformed stories on the Cybertruck, which we have found to be unfair at best or manipulative at worst. We prioritize truth, and the best way to accurately tell our story is here on X. To start, we’ve already shared our Cybertruck journey in depth with our past posts. Here's a summary for those who’ve not read our above review. The Cybertruck is the most versatile vehicle ever produced, excelling at multiple, often disparate skill sets. For example, imagine if you had a Venn diagram with circles for off-road, luxury, racing, work truck, safe family vehicle, and tow rig. This is potentially the only vehicle ever made that could overlap each with flying colors. It is hard to fathom a vehicle that can check off more than 3 of those since many are completely opposing concepts, never mind all 6. It is an engineering marvel and a joy to drive. In our week documented, we experienced every one of those criteria except construction site work. Yet, despite how amazing of an experience we’re having with the truck, the internet has been doing internet things. Namely stoking drama. In the past 48 hours, we have seen it brewing. Why? Because we ran KOH for two epic days in the dirt and at the end of day two we broke a bolt. It's as if the world has never seen anything break on a truck going off-roading. But hey, this is the Cybertruck, and everyone seems to want to angle an opinion. If it were any other vehicle, we’d have broken a bolt, and nobody would care. In fact, as Optima, who hosted the KOH event we participated in, said, a Ford Raptor R broke down similarly. x.com/OptimaBatterie… I hope the Raptor R owner doesn't have to deal with a thousand questions and conspiracy theories like we are. So here we are, racing the truck at Buttonwillow, towing with it, driving it daily, ripping it around KOH, and having a great time. Imagine what that’s like when you inspect a broken bolt, disassemble the suspension to access it, and everyone is taking photos with the wheel and suspension off. Then, later, you go online and see people using those images to make up and reinforce whatever story best suits their interests. We’ve raced for decades, and things break; sometimes, full cars break. It is hard and was especially hard at Pikes Peak, but that’s part of the experience. We never had to worry about people taking photos without asking us and making up scandalous stories like this. Yet here we are. Because in 2024, on the internet, everyone wants to prove true whatever their biases are, and they’re willing to take incomplete or false information and brand it as their facts if it suits them. Well, here are the simple facts. We drove the hell out of the truck, and we had a fantastic time; a bolt broke on the rear steering rack at the end of the day. Anticlimactic, isn’t it? So many accusations have been lobbed our way during this journey. Most have been so ridiculous they didn’t warrant a comment. It is disheartening that “car enthusiasts” take such a negative stance when we’re out enjoying our truck, looking for great motoring experiences and ways to enhance the vehicles even further. Previously, our activities were supported by fellow car enthusiasts, but now more and more people are looking for gotcha moments. We will thread a reply addressing a few “gotcha” moments people have tried to lob at us. The point here is to address them head-on and then make this the last post about these subjects and move on. To wrap up - We love the truck, and we’re going to be exploring all of the capabilities of it. We’ll add value whenever possible by modifying it to tackle the most extreme challenges. We hope the internet will be more balanced and fair with us and with other Cybertruck drivers, although we’re realists, and we don’t expect it. We just ask before believing whatever someone says; please consider thinking critically and perhaps look to the source for their facts before applying someone else's. The spread of misinformation is not only disheartening but also toxic to the car culture we love.
