@Rowd_19 @aradboaz It was taken out because it was overly vague and likely unconstitutional. The law targets terrorist acts with a motive to negate Israel’s existence and that’s fairly reasonable and clear. Those who don’t commit terrorist acts with this aim will be fine.

Israel’s new death penalty law is widely described as exclusively targeting Palestinians. That’s not just an overstatement it’s wrong. In Israel proper it formally applies to anyone committing a lethal terrorist act aimed at negating Israel’s existence. This includes Israeli Arab citizens on identical terms to Jews. The military court track applies only to West Bank Palestinians, but that reflects existing jurisdictional reality, not ethnic targeting in the text. Settlers, as Israeli citizens, are legally subject to Israeli civil courts even though they are in the West Bank. This is the internationally recognised position for an occupying power’s own civilians. Claims that thousands of already-convicted Palestinians face execution are simply false; the law is prospective only and won’t be applied retrospectively, even to 7/10 terrorists. The legitimate criticism is that the law’s net effect will fall disproportionately on West Bank Palestinians. Moreover, the military track carries a harsher mandatory sentence than the civil one, and it operates against a backdrop of chronically under-prosecuted settler violence. But that last point is an enforcement failure within Israel’s civil court system not a jurisdictional anomaly, or a function of this new law. That said it’s a real and well-documented issue, with many in Israel’s security establishment describing organised settler violence as terrorism. That asymmetry is absolutely worth criticising clearly. But it’s a criticism that’s likely to get lost as the more lurid claims take the attention.

@Rowd_19 @aradboaz Bills go through all sorts of linguistic changes and edits to withstand judicial review. The wording of the bill was changed after groups like Adalah voiced concern that it would result in discriminatory outcomes and so it was. What’s the issue?

@barlow2021 @colwight Yes, it was an egregious and comical lie back then, as well. Even Hamas who inflate their numbers and don’t differentiate between civilian and combatant deaths are not claiming these numbers. They have them at 72k currently.

@Rowd_19 @aradboaz It’s evident that lowering the bar by removing a unanimous 3/3 decision and replacing it with a simple majority and also removing the possibility of an appeal or commutation through this law is intended to permanently dispatch terrorists instead of giving them life.

@Rowd_19 @aradboaz The intent is determined through the courts by a series of criteria. Presence of manifestos, communications, etc. that specify the actor’s goal is the elimination of Israel. Targeting of high ranking officials opposed to random violence. Organizational doctrine and affiliation.

@Gothtos @aradboaz What grievance? It’s a law that will harm Israel and provides it zero benefits. In practice no Jew will ever be given the death penalty, only Arabs. Whilst at the same time that crimes against Arabs are increasing by settlers. The only people supporting Israel will be frum Jews.

@Rowd_19 @aradboaz No. Terrorism is robustly defined in Israel’s 2016 counter terrorism law. You not knowing what it entails is not an excuse to invent your own set of facts. The bar that triggers the death penalty now is that it must include the intent to “end the existence of the State of IL.”
