A law professor at Queens describes Hamas as a “non state armed group” and “Palestinian armed groups” attacking “legitimate military targets” against an “occupying force.” Hamas is a listed terror organization, that has no legitimacy to attack anything. And Gaza has not been occupied for over 18 years.

It’s not “next level lawyering” or “willful stupidity”; it’s standard international practice. Claimants (or applicants) routinely preserve jurisdictional objections in submissions, including via footnotes or reservations, precisely to avoid any argument of waiver by conduct while still advancing their case on the merits. Jurisdiction and merits are distinct; arguing the latter does not automatically forfeit the former. Competent counsel builds in these safeguards because tribunals expect precision on consent-based jurisdiction. This is textbook risk management in ICJ, ICSID, UNCITRAL, and other international proceedings. Parties plead in the alternative or explicitly reserve rights all the time; it’s basic procedure to protect against implied acquiescence. Dismissing it as something a lawyer “shouldn’t teach” ignores how these cases actually work. See, e.g., Oil Platforms (Iran v. US) at the ICJ, and countless ICSID cases (such as those against Argentina) where claimants advance merits arguments while preserving jurisdictional positions in submissions or footnotes, precisely to avoid waiver arguments. We have filed, on behalf of our Palestinian client, a demand for warrants for the leadership of Hamas at the @IntlCrimCourt for the crimes committed by the terrorist government of Gaza against the Palestinian people. @KarimKhanQC and the Office of the Prosecutor cannot say that they truly care about justice if they continue to ignore the blatant crimes committed against the Palestinian people by Hamas. These crimes include numerous crimes against humanity and war crimes committed by Hamas against the Palestinian people. Notably including the war crime of utilizing the presence of civilians or other protected persons as human shields. There has never been a demonstration that the Palestinian's are willing and able to investigate Hamas for these crimes. Hamas' purposeful conduct in Gaza has greatly exacerbated the harm against Palestinian civilians. The unnecessary suffering of the Palestinian people must be accounted for and the ICC cannot claim to care about justice if it remains silent on these crimes. Thankful to the work of my colleagues, Eli Rosenbaum, and @sarah_scialom, and our brave client who came forward to tell their story.

🔵Press Release: Statement by the Israeli Embassy in Canberra Regarding Gaza Flotilla The return of the Gaza flotilla participants has attracted significant international attention and prompted a range of serious allegations against Israel, including claims of physical mistreatment and sexual abuse. Israel categorically rejects these allegations and maintains that serious claims of this nature must be backed by credible evidence and grounded in fact. It is also important to recognise that this is the fourth flotilla organised for provocation rather than humanitarian concern. The flotillas have not been driven by legitimate humanitarian objectives, but by an orchestrated political campaign that serves the interests of Hamas. Some governments, including Australia, advised against participation. Several figures associated with the flotilla are well-known agitators with documented links to organizations connected to Hamas and other terrorist groups. The United States has imposed sanctions on four activists associated with the flotilla. While it is reasonable to assume that some participants were naïve, it is also clear that others operate as professional provocateurs advancing a political agenda. Inspections of the flotilla also showed no meaningful humanitarian cargo on board. In contrast, there are lawful and effective mechanisms already in place delivering humanitarian aid to Gaza. Since October 2023, more than 1.5 million tons of humanitarian aid have entered Gaza. On average, hundreds of trucks enter daily delivering assistance through coordinated international systems. Flotilla organizers were explicitly offered the option to transfer any humanitarian cargo through these established and secure channels. That offer was refused. The conclusion is that this flotilla is not a humanitarian delivery mechanism operating in good faith. Claims that the blockade of Gaza is illegal are also untrue. The maritime security measures in place around Gaza are not designed to block aid but exist to prevent the smuggling of weapons and other materials to Hamas. The legality of the naval blockade has been recognized internationally, including in the 2011 Palmer Report. The provocateurs were neither tortured nor raped. Such claims are entirely baseless and are intended solely to advance the provocateurs’ smear campaign against Israel. Allegations of abuse, torture or sexual assault are serious claims. No real evidence was presented to support them. While claims of abuse have not been substantiated, some participants have been photographed on stretchers, posing as injured. They then reveal miraculous recovery, posing in other photos looking very healthy. If there is any genuine evidence or complaint, it should be filed through the appropriate channels for thorough examination by the competent authorities. In cases where provocateurs behaved violently, non-lethal measures were used, similar to measures employed against rioters in Europe. Israel condemns any attempts to exploit humanitarian concerns to advance political purposes. Rather than contributing to genuine humanitarian outcomes, the Gaza flotilla has undermined them and distracted from actual efforts to support civilians. Israel remains committed to facilitating humanitarian assistance through secure and effective channels, while continuing to act in accordance with international law.

Tove Lifvendal, som jag förr var Facebookvän med - hon har nu tagit bort mig - är en av många välmenande svenskar som bara helt enkelt inte kan tänka sig att Israel ljuger. Allt de framför ska vi tro på, precis som vi tror på Norge och Kanada. Och då blir det förstås obegripligt för henne att inte världen tar denna rapport på allvar. Jag var pinsamt länge likadan. Jag ändrade mig, som ni vet som följt mig ett tag, när jag insåg vidden av de många lögner Israels regim producerar. När jag begrep att Hasbara inte är ett skällsord utan en strategi. Det jag vet är att om inga belägg fanns i början av 2024, när FN gjorde en omfattande utredning och inte fick tillgång till vare sig bildbevis eller obduktionsprotokoll eller förstahandsvittnen lär de inte plötsligt bara ha dykt upp nu. Och jag påminner om att det inte finns någon kvinna som säger sig ha blivit våldtagen, och ingen kropp uppvisade bevis för våldtäkter. Det jag vet är att Hamas tagit ansvar för allt annat som hände den dagen, men mycket bestämt nekar till att ha beordrat våldtäkter. Vad skulle de ha för motiv till att beordra dem och sedan blåneka? Så funkar inte terror. Det jag också vet är också som sagt att för Israels hasbara-apparat som bevisligen ljög då och har ljugit sedan många år är just anklagelserna om stympningar och våldtäkter centrala - de bidrar till dehumaniseringen av palestinier. Rapporten förväntar sig att vi ska tro en ljugande nation på dess ord utan andra bevis. Det som också är värt att påpeka är att Israel i dagarna fått sen men välförtjänt och omfattande kritik för deras många synnerligen bevisade systematiska våldtäkter mot palestinska kvinnor i Gaza och på Västbanken och palestinska män i fängelser, och att rapporten kom ut samtidigt som den kritiken.
