@bphillipsonMP, section 14(7) EA2006 states that ON RECEIVING a draft code, the SoS shall approve the draft, notify the EHRC and lay a copy before Parliament; or give the EHRC written reasons why she does not approve it. Half a year and no action = likely you're breaking the law.

@asifamhp @DrJohnABaker You can be made subject to section 5 if you are in A&E if you are in fact an inpatient. Unlikely but entirely possible.

@Guy____Davis @DrJohnABaker >just off it. In theory u can be detained on S.2/3 to an A&E in a hospital registered for the purpose & willing to accept the AMHP application. But not be made subject to S.5 provisions. >

@asifamhp @DrJohnABaker Any hospital can be a PoS, so yes they will need to agree for that place to be used for 135/136 purposes. Re 5(2), the person must be an inpatient, which theoretically they could be anywhere in the building. As such, ss.2 or 3 could be used, they would obvs have to accept though.

@asifamhp @DrJohnABaker In respect of application of the Mental Health Act 1983, the nature of the department is largely irrelevant; it's the patient's status at the time that is key..........1/2

@RITB_ @NHSEngland It wasn't updated when the MHA was amended by the Policing and Crime Act 2017. It will be next year though.

Early goals from Patrick Bamford and Harrison Burrows meant Sheffield United were cruising against rivals Sheffield Wednesday. That was until Kalvin Phillips was sent off. The on loan Manchester City midfielder was sent off after a horrendous follow through on Svante Ingelsson. Charlie McNeill gave Wednesday a lifeline just four minute later.

@NeilAllen39 Very unhelpful for the MoJ to be describing this as 'supervised discharge'; it's no such thing and the term does not appear in the Act! Furthermore, the Tribunal service won't be referring to this discharge power in that way.

🚨 Today, 18 February 2026 — the first amendment to the MHA 1983 comes into force. Restricted patients can be conditionally discharged with conditions amounting to a deprivation of liberty in the community. But some knotty issues lie ahead me thinks. On Valentine’s Day 36 years ago, at the request of Carl Sagan, NASA turned Voyager 1's camera back toward home for one last look. From 3.7 billion miles away, it captured this: a mote of dust suspended in a sunbeam. Here is how Carl Sagan beautifully described it: “Look again at that dot. That's here. That's home. That's us. On it, everyone you love, everyone you know, everyone you ever heard of, every human being who ever was, lived out their lives. The aggregate of our joy and suffering, thousands of confident religions, ideologies, and economic doctrines, every hunter and forager, every hero and coward, every creator and destroyer of civilization, every king and peasant, every young couple in love, every mother and father, hopeful child, inventor, and explorer, every teacher of morals, every corrupt politician, every 'superstar,' every 'supreme leader,' every saint and sinner in the history of our species lived there — on a mote of dust suspended in a sunbeam. The Earth is the only world known so far to harbor life. There is nowhere else, at least in the near future, to which our species could migrate. Visit, yes. Settle, not yet. Like it or not, for the moment the Earth is where we make our stand. It has been said that astronomy is a humbling and character-building experience. There is perhaps no better demonstration of the folly of human conceits than this distant image of our tiny world. To me, it underscores our responsibility to deal more kindly with one another, and to preserve and cherish the pale blue dot, the only home we've ever known.”

@sharrond62 @bphillipsonMP After 5 months, she is probably breaking the law. Section 14(7) of the Equality Act 2006 states that ON RECEIVING a draft code, she shall approve the draft, notify the EHRC and lay a copy before Parliament; or give the EHRC written reasons why she does not approve it.

This woman, @bphillipsonMP who says she supports females (she doesn’t) could stop women & girls losing out in sport or losing their safeguarding in confined intimate spaces straight away. Instead of us having to go to court to get the law applied.
Tom Harris 🇬🇧@MrTCHarris

A reminder that it has now been 157 days since the @EHRC sent @bphillipsonMP its draft guidance on single-sex spaces. But she has yet to table it in parliament.
