@bphillipsonMP, section 14(7) EA2006 states that ON RECEIVING a draft code, the SoS shall approve the draft, notify the EHRC and lay a copy before Parliament; or give the EHRC written reasons why she does not approve it. Half a year and no action = likely you're breaking the law.

@asifamhp @DrJohnABaker Any hospital can be a PoS, so yes they will need to agree for that place to be used for 135/136 purposes. Re 5(2), the person must be an inpatient, which theoretically they could be anywhere in the building. As such, ss.2 or 3 could be used, they would obvs have to accept though.

@RITB_ @NHSEngland It wasn't updated when the MHA was amended by the Policing and Crime Act 2017. It will be next year though.

The MHA code of practice has still not been updated over 2 years on since @NHSEngland appears to have unilaterally decided to end the care programme approach #CPA #BringBackCPA

This woman, @bphillipsonMP who says she supports females (she doesn’t) could stop women & girls losing out in sport or losing their safeguarding in confined intimate spaces straight away. Instead of us having to go to court to get the law applied.
