On 19.09.2025, in the ruling attached herein, which was delivered in OKIYA OMTATAH OKOITI VS H. E DR. PAUL NYONGESA OTUOMA, THE GOVERNOR BUSIA COUNTY AND ATHI LIMITED AND 1 OTHERS (BUSIA HCCHRPET/E001/2024), a three-judge bench of the High Court sitting at Vihiga ruled: 1. Senators, acting individually, cannot exercise their role of oversighting County Governments. The exercise of sovereign power by the people through their democratically elected representatives contemplated under Article 1(2) of the Constitution can only be realised through their representation in the Senate. 2. A Senator, like any citizen, has the right to request and access information on the operations/transactions of a county government, and the county government has a legal obligation to supply the information requested. 3. Because he has supervisory powers over the CEC, a governor is accountable for the entire process of procuring goods and services in a County. @YoroAbdull @WilliamsRuto @Wavinya_Ndeti Nairobi is worse! It’s too much extortion countrywide. Some counties even charge these permits and licenses per constituency. Contrary to the Constitution of Kenya 2010.

Okiya Omtata is the man who will not hesitate to lock up all the looters since the 60's, go out of his way to try and recover as much loot as possible and set us back on the path to political morality/hygiene. We need him more than he needs us though I'm not sure we deserve him.
