The 72nd Report, presented to the Rajya Sabha and Lok Sabha on August 30, 2013, examined the irregularities in studies involving Human Papilloma Virus (HPV) vaccines conducted by the Programme for Appropriate Technology in Health (PATH), a U.S.-based organization funded by the Bill and Melinda Gates Foundation. The inquiry was triggered by media reports in March 2010 about deaths among female children and adolescents in Khammam district, Andhra Pradesh, following HPV vaccine administration, with similar concerns in Vadodara, Gujarat. The project began in 2006 as a collaboration between PATH, the Indian Council of Medical Research (ICMR), and state governments in Andhra Pradesh and Gujarat. It targeted girls aged 10-14 from vulnerable tribal and low-income communities, vaccinating approximately 23,500 participants (14,091 in Andhra Pradesh with Gardasil by Merck, and 10,686 in Gujarat with Cervarix by GlaxoSmithKline). PATH framed it as a "demonstration" or "observational" project to generate data for introducing HPV vaccines into India's Universal Immunization Programme (UIP). The report classifies it as a clinical trial due to its invasive nature, data collection on adverse events, and intent to influence public health policy for commercial benefit. The trials were suspended in April 2010 amid public outcry, and an Inquiry Committee was formed to investigate. The Committee highlighted several procedural, ethical, and legal lapses. ICMR signed a 2007 MoU with PATH before vaccines were approved in India, bypassing advisory bodies like the National Technical Advisory Group on Immunization (NTAGI). The Drugs Controller General of India (DCGI) granted irregular approvals and import licenses without enforcing rules, such as requiring prior trials on adults before children. Severe violations occurred, including incomplete forms, post-vaccination signatures by unauthorized individuals (e.g., hostel wardens), lack of witnesses, and no proper risk explanations. Many parents were illiterate, and thumb impressions were used without verification. Under-reporting of serious adverse events (SAEs) and non-SAEs; no protocols for emergencies like anaphylaxis; delayed investigations into deaths (seven reported, attributed to unrelated causes like suicide or malaria without autopsies) were called out. PATH operated without required approvals from the Ministry of External Affairs (MEA) or Home Affairs (MHA). Government resources, including National Rural Health Mission (NRHM) funds and logos, were misused to lend credibility, blurring lines with official programs. Vaccines were approved in 2008 without mandatory Phase III trials in Indian children, violating Drugs and Cosmetics Rules. The project violated Indian laws, international ethical standards (e.g., Declaration of Helsinki) prioritizing commercial interests over participant safety. After the quoted post below, I haven't posted much. Firstly the two weeks after the judgement were busy with the preparations on the written submissions. I then got into a contemplative mood (especially after some events surrounding the submission itself) and decided that I needed a different forum and format to share and mobilise views around important matters that impact our lives. To be fair, X was never intended to be one. It's a microblogging platform after all. May be good to share some breaking news. To share views on some global events. Just as a blip. But to present facts and facilitate a mature discussion on important subjects, this is a total misfit. Add to that, the different forms of censorship, including limiting reach, by the platform itself. So I decided against spending my time in X, which has a disproportionately small result compared to the effort and time that goes in. So I might get active in some other platform/a focussed website after a few months, to present views and to participate in discussions in a structured way. But in the meanwhile I thought I must share the below with the friends (too many to name here) who have taken an interest in the vaccine victims' cases, who have actively supported me through last 3+ years, who have contributed a lot with their research and posts in raising the vaccine awareness in people who were willing to listen and think. The GoI filed their written submission more than a month after the order, 3 weeks after the time given by the Hon'ble Court to file the submission, on 24th December. I am looking forward to receiving an order that will ensure that the fundamental rights enshrined in our constitution are protected for all. An order that will make informed consent obligatory for all public health interventions in letter and spirit, go into the grave omissions and commissions by people who were meant to protect public health and one that brings forth systemic remedies that will protect the citizens and familes of this country from the tragedies such as those befell my family and countless others. An order that will give due justice those who have been wronged. I would urge those who are following this matter to read the submissions to understand the position of the petitioners and the Government, which is the first respondent. The other two respondents, ICMR and DCGI, have not made any representations right from the beginning of the case. Many of our submissions refer to earlier documents such as our writ petition of October 2021 and the rejoinder filed in 2022.
