📰EXCLUSIVE: Cease and Desist Letter Representing Pinnacle High School Parents sent to Pinnacle High School in Phoenix Leadership, Principal, Superintendent, School Board, Arizona Board of Regents @AZRegents , Arizona Department of Education @azedschools , and @ArizonaAG @krismayes @AZAGMayes demanding the TPUSA event not just be moved off Campus but Cancelled Entirely: CEASE AND DESIST DEMAND The Paradise Valley School Board and Superintendent and Pinnacle Highschool Principal and leadership are directed to immediate and Full Cancellation of Turning Point USA (TPUSA) / Erika Kirk Speaking Event in the Paradise Valley Unified School District and not merely moving the event off campus. Failure to comply will result in the immediate filing of a federal lawsuit (and parallel state claims) seeking: (a) a temporary restraining order and permanent injunction prohibiting the event; (b) declaratory judgment that the District’s actions violate the First and Fourteenth Amendments, Title VI, and Arizona statutes including A.R.S. § 15-341; (c) compensatory and punitive damages; and (d) attorneys’ fees and costs under 42 U.S.C. § 1983 and other applicable laws. We will simultaneously file complaints with the U.S. Department of Education Office for Civil Rights and the Arizona Department of Education. This demand is made to protect the constitutional rights, safety, and well-being of all PVUSD students, consistent with the District’s mandatory duties under Arizona law. We expect your prompt written confirmation. The Arizona Attorney General and Arizona Board of Regents has been copied on this CEASE AND DESIST DEMANDDear Members of the Paradise Valley Unified School District Governing Board: This letter serves as a formal Cease and Desist Demand on behalf of concerned parents, guardians, and students of the Paradise Valley Unified School District. You are hereby required to immediately cancel and prohibit the scheduled appearance of Erika Kirk, CEO of Turning Point USA (TPUSA), or any TPUSA-affiliated speaker or representative, at Pinnacle High School on or around the week of April 24, 2026, or at any other time or location on district property. The event—described in the district’s own letter to parents as an opportunity for Ms. Kirk to “share her personal journey and life experiences” with the TPUSA-affiliated “Club America” student group during the school lunch period—must be canceled for the following compelling legal reasons. Failure to comply will expose the District to immediate litigation for constitutional violations, negligence, breach of statutory duties under Arizona law, and related claims including a class action lawsuit against Pinnacle High School, The entire Pinnacle leadership individually, the Paradise Valley School Board Members Individually and as a whole, the Paradise Valley Superintendent, and all other involved parties. 1. Imminent Safety Threats and Violation of the District’s Statutory and Common-Law Duty of Care Self proclaimed safety threats exist against Erika Kirk and TPUSA events, including “very serious threats” per TPUSA that recently forced her to cancel a major public appearance with Vice President J.D. Vance. These threats arise directly from the content and viewpoint of TPUSA’s activities. Allowing this event on school grounds—whether during lunch, after hours, or off-campus under district facilitation—creates a foreseeable risk of substantial disruption, protests, violence, or harm to students, faculty, and staff while they are under the District’s custody and control. Arizona school districts have a clear statutory duty to protect student health and safety. Under A.R.S. § 15-341(A), each school district governing board shall:Prescribe and enforce policies and procedures to govern the schools (A.R.S. § 15-341(A)(1)); Hold pupils to strict account for disorderly conduct on school property (A.R.S. § 15-341(A)(12)); and Prescribe and enforce policies and procedures to prohibit harassment, intimidation, and bullying, including procedures designed to protect the health and safety of pupils who are physically harmed (A.R.S. § 15-341(A)(36)). Arizona courts recognize that schools owe students an affirmative duty to protect them from known and tangible risks of harm while under the school’s custody and control. Proceeding with the event despite threats would breach this duty and expose the District to tort liability for negligence. Schools may and must restrict speech or events that pose a substantial disruption (Tinker v. Des Moines Independent Community School District, 393 U.S. 503 (1969), applied in Arizona contexts). The District cannot endanger students while claiming neutrality. We will seek injunctive relief and damages if this event proceeds. 2. Violation of Separation of Church and State (Establishment Clause) and Related Arizona Duties TPUSA operates an explicit religious arm known as TPUSA Faith and promotes ideologies that seek to infuse public education with specific religious viewpoints. Erika Kirk and TPUSA leadership have publicly tied their mission to restoring “biblical values” in schools and government. Hosting a TPUSA leader on public school property—even for a purportedly “student-led” club meeting—risks government endorsement of religion in violation of the First Amendment’s Establishment Clause. Arizona law reinforces this separation. Under A.R.S. § 15-341(A)(2), school district governing boards shall “[e]xclude from schools all books, publications, papers or audiovisual materials of a sectarian, partisan or denominational character.” Facilitating a speaker whose message advances religious viewpoints during school hours or on school grounds contravenes this statutory mandate and exposes the District to liability for impermissible entanglement with religion. Public schools may not facilitate or appear to endorse religious messages. Courts have repeatedly struck down similar school-sponsored or school-facilitated religious activities. 3. Promotion of Racism, Discrimination, and a Hostile Educational Environment in Violation of Federal and State Law TPUSA and its affiliates have a documented record of promoting discriminatory ideologies, including rhetoric that denies systemic racism, associates with extremist elements, and fosters division based on race, ethnicity, and other protected characteristics. Permitting a TPUSA speaker to address students—particularly in a captive school setting—creates a hostile environment for students of color, LGBTQ+ students, and other protected groups. This violates Title VI of the Civil Rights Act of 1964 (42 U.S.C. § 2000d et seq.), which prohibits racial discrimination in federally funded programs, as well as Arizona’s parallel obligations. Arizona law requires school boards to prescribe and enforce policies prohibiting harassment, intimidation, and bullying that could create a hostile environment (A.R.S. § 15-341(A)(36)). Schools cannot knowingly expose students to content that promotes hate or discrimination under the guise of “viewpoint diversity.” Failure to act would also risk violating the Fourteenth Amendment’s Equal Protection Clause and Arizona anti-discrimination requirements. If the District allows this while denying other speakers on neutral grounds, it would compound viewpoint discrimination issues—yet here the content itself triggers liability. 4. Additional Constitutional and Statutory Violations The District’s actions risk unbridled discretion in forum management and potential content-based favoritism, contrary to First Amendment requirements for limited public forums. Schools cannot invite or accommodate speakers whose message foreseeably causes substantial disruption or violates core constitutional and statutory protections, including those under A.R.S. § 15-341. DEMAND You are directed to confirm in writing within 48 hours of receipt of this email that:The Erika Kirk / TPUSA event has been fully and permanently canceled; No TPUSA-affiliated speakers or events will be permitted on district property or under district auspices; and The District will issue a corrective communication to parents and students confirming the cancellation.
