@buperac I don’t see a problem with the life insurance loan. If he wants he should be able to keep kicking the can down the road and renewing the loan as long as with interest the loan does not exceed the policy amount. Or am I wrong?

The Monette Farms court filing has a $23.9 million detail that quietly changed between the 2024 and 2025 audited financial statements. Here is what happened. The company says it has an "imminent liquidity shortfall" and can't afford to put a 2026 crop in the ground. They need access to $40 million. But it also carries roughly $48 million in personal life and critical-illness insurance on Darrel Monette which is funded by corporate debt, not personal premiums. The biggest piece is a $23.9 million loan from a company called D.S. Wealth Solutions Ltd. That loan was taken out specifically to pay the upfront premium on a critical-illness policy that pays Darrel personally up to $22.9 million, plus $161,600 per month if he is disabled. In the 2024 audited statements, that loan is listed as "due in full May 2026." In the 2025 audited statements, the same loan is now "due in May 2030." May 2026 is the same month the company's $830 million senior debt was set to mature. May 2026 is the same month they filed for CCAA bankruptcy protection. If the loan had stayed at its original 2026 maturity, Monette would have faced a $23.9 million balloon payment right in the middle of the bankruptcy filings and the spring seeding crisis. Pushing it to 2030 means the corporate-funded personal insurance shield survives the entire bankruptcy intact, while ordinary creditors take the loss. Two questions worth chasing. Who actually controls D.S. Wealth Solutions Ltd., and what relationship does that company have to the Monette family or any of its 18 affiliates? What did Monette give up extra collateral, higher interest, additional security against the policies to get a four-year deferral on a $23.9 million obligation right before declaring insolvency? It’s time. Monette has filed for protection under the CCAA, the same thing AgraCity did. A letter has gone out from Darrel to try and keep all the wolves at bay. Notice the language use. “Our intention is to keep leases current” There is no guarantee here, I would be nervous as a landlord. “Farming operations continue, including seeding, crop care, and harvest planning” Note they say harvest planning. Not executing harvest, they must have a really short runway. “Lease agreements remain in force and we intend to maintain ongoing operations” Another one here, intend to maintain. They are going to cut out sooner rather than later it seems. They must be putting in minimal inputs to use this verbage. “with the goal of timely payment.” This is for rent obligations, if it were me I wouldn’t expect to get paid. What a goal. Darrel finally tells the landlords to reach out to the management but if he really wanted to put them at ease he would have told them to reach out to him directly. This is bad, very bad. This is a court-supervised restructuring process that allows us to continue operating while we stabilize finances and restructure debt. Our priority is to protect the productive capacity of the farm and manage obligations—including land rent—in an orderly, predictable way. This filing is a proactive response to current industry pressures (higher input costs, higher interest rates, and tighter credit) and is not a liquidation. We are working with our advisors and a court-appointed Monitor to develop a restructuring plan for creditor and court approval. CCAA is not bankruptcy or a shutdown. It is a federal restructuring framework with court oversight intended to give a viable business time to develop and implement a plan, while continuing normal operations where possible. We understand that the main question for landowners is how this affects lease performance and rent. Our intention is to keep leases current and to communicate clearly about timing and process.
