Sure sounds like a de facto ban on certain flavors - rather than a case by case analysis of each PMTA. De facto ban would require a rule making.

The FDA will continue to deny approval to the most popular flavors smokers use to quit smoking. "The agency said that it would consider vapes in flavors such as mint, coffees, teas and spices, possibly like clove or cinnamon. 🚨 FDA released the 2025 National Youth Tobacco Survey. Here are the numbers, and it's good news if you don't want kids using nicotine, bad news if you want to try to use kids to justify prohibition: High school past-30-day use: • E-cigarettes: 7.1% • Nicotine pouches: 2.2% • Cigarettes: 1.8% • Any combustible: 3.5% Middle+high combined: • E-cigarettes: 5.2% • Cigarettes: 1.4% • Nicotine pouches: 1.6% Source: 2025 NYTS public use file, FDA.
