Official Statement: Major Reform to the Unduly Lenient Sentence (ULS) Scheme After seven years of relentless campaigning through the Josh Hanson Trust, I am claiming a significant and long-awaited victory for victims’ rights. Following our extensive advocacy, the Government has agreed to transformative amendments to the Unduly Lenient Sentence (ULS) scheme. The Historic Wins for Victims: •The justice system will now be legally required to inform victims and bereaved families of their right to appeal a sentence. •In a major shift, the window for victims to appeal has been extended from just 28 days to 6 months. •Crucially, if a victim has not been informed of their right to appeal, they will now be permitted to do so after the 6-month period under special circumstances. These changes represent a hard-fought victory in ensuring that families are no longer left in the dark or rushed through a traumatising process during the most painful moments of their lives. However, I am deeply disappointed that the Government has chosen not to name these changes ‘Josh’s Law’. This decision does not honour the seven years of evidence and advocacy that drove this reform. It does not just ignore my son Josh and what we have been through as a family, but the hundreds of bereaved families and victims who we continue to advocate for through our charity The Josh Hanson Trust every year. Furthermore, a critical injustice remains parity of time. While the extension to 6 months is a massive step forward, victims are still not afforded the same timeframe as offenders. True justice requires an equal playing field; until victims have the absolute same window of duration to act as the offender, the system remains fundamentally unbalanced. I would like to thank the Victims’ Commissioner for England and Wales, Max Lawson Policy Officer for Victims Commissioner for London and Baroness Brinton who has continually and tirelessly supported our campaign for their support. These reforms are a testament to Josh’s memory and the dedication of everyone who stood with the Josh Hanson Trust. I have been calling for Josh’s Law since 2019. Josh’s Law would ensure victims can appeal outside of the strict 28-day deadline in exceptional circumstances as is afforded to offenders. My application under the Unduly Lenient Scheme while submitted on the 28-day was denied by the Attorney General’s Office as it was received outside of office hours. This information was not made public and no one gave me any advice at the time. Every single day victims leave the criminal courts not being informed of their right to appeal a sentence and this needs to stop right now.
