The Gensler SEC destroyed documents they were required to preserve and produce. We now have proof from the SEC’s own Inspector General. Today we ask the federal court to address this gross violation of public trust to ensure that it never happens again. 1/3

Ripple is dropping our cross appeal, and the SEC is expected to drop their appeal, as they’ve previously said. We’re closing this chapter once and for all, and focusing on what’s most important – building the Internet of Value. Lock in.

With this, the ball is back in our court. The Court gave us two options: dismiss our appeal challenging the finding on historic institutional sales—or press forward with the appeal. Stay tuned. Either way, XRP’s legal status as not a security remains unchanged. In the meantime, it’s business as usual.

The final crossing of t’s and dotting of i’s – and what should be my last update on SEC v Ripple ever…
Last week, the SEC agreed to drop its appeal without conditions. @Ripple has now agreed to drop its cross-appeal. The SEC will keep $50M of the $125M fine (already in an interest-bearing escrow in cash), with the balance returned to Ripple. The agency will also ask the Court to lift the standard injunction that was imposed earlier at the SEC’s request. All subject to Commission vote, drafting of final documents and usual court processes.

I’m in NYC today and spoke briefly with @bgarlinghouse, who, understandably, is in a very good mood. 😂
People need to remember, the company @Ripple wasn’t the only one sued, @bgarlinghouse & @chrislarsensf were sued individually, which is not usually done in a NON-FRAUD CASE. Imagine having to tell your young kids: “Dad is being sued by the United States government.” The relief must be intense. In addition, the U.S. market dried up instantly because no financial institution is going to do business with a company actively being sued by the @SECGov.
Garlinghouse said some interesting things on stage at @blockworksDAS about the industry.
@CGasparino, with help from @EleanorTerrett, on @LizClaman’s show, reported on the significance of this case - for the entire industry - before anyone else. I happen to be in NYC today. 😉 😝
