@MarshallZNews MORE ANALYSIS: Was the order to resentence Tina Peters a surprise? No. Being in court for the Appeals hearing, it was clear the judges were concerned the sentencing judge went beyond deterrence and Peters’ lack of remorse and got into impermissible territory around her speech.

And kudos to @MarshallZNews who caught that Peters’ claims of a sentencing error on a felony charge (to which the Court of Appeals seemed sympathetic) was based in an error because the law changed. The Court of Appeals noted that in rejecting that claim. 9news.com/article/news/p…

ANALYSIS: Peters’ nine-year sentence surprised many following her case (myself included). I said that day it seemed like the meter was running as Peters relitigated her case and argued with the judge at sentencing. His references to her speech being a danger led to the reversal.

Gov Jared Polis (D) has appeared eager to commute Peters’ sentence as President Trump has demanded, as Trump carries out promised retribution against Colorado for Peters’ imprisonment. But, for the moment, Peters doesn’t have a sentence to commute. And Polis has said no pardon.

Judge Barrett could give Peters the same sentence without using the language that caused the Court of Appeals to reverse (seems unlikely) or a shorter sentence. Peters was parole eligible in early 2028 based on her first sentence.

The Court of Appeals rejected Peters’ request for a different judge, saying that must first go before a district court. So the case goes back to Judge Matthew Barrett, who excoriated Peters (improperly, in part, in the eyes of the Appeals Court) after her diatribe at sentencing.

Peters appealed her conviction and sentence on a total of nine grounds. The Court of Appeals rejected eight but agreed that “it is apparent that the court imposed the lengthy sentence it did because Peters continued to espouse the views that led her to commit these crimes.”
